Vacancy Defined. A vacancy shall be defined as a newly created position, or a present position that is not filled and that the Board intends to fill.

Vacancy Defined. When a position has been created or a current position has been vacated, which is intended to be filled, a vacancy exists.

A "vacancy" is a newly created or current position within a classification represented by the Association in this bargaining unit which becomes vacant due to the permanent separation (resignation, death, discharge) of the bargaining unit member formerly in the position or when an employee is on leave of absence under this Agreement for more than six (6) months. No vacancy shall exist unless and until the Board determines to fill any such position, which determination shall be within the sole discretionary authority of the Board.

The following shall be considered a vacancy: A newly created position; or A position vacated by retirement, resignation, termination, or transfer; or A position vacated by an employee on an authorized unpaid leave of absence for which the anticipated date of return is greater than 2 month(s) from the beginning of the leave. Vacancy Defined. Vacancies in bargaining unit positions are those non-promotional positions vacated as a result of death, resignation, retirement, termination of contract, non-renewal of contract, transfer, or the grant of a disability leave of absence for a duration of one year or more, promotion or the creation of a new position.
