VACANCIES/PROMOTIONS. Section 8.1. Whenever the Employer determines that a vacancy exists within the bargaining unit which the Employer intends to fill, and such a vacancy is not filled through recall from a layoff list, the Employer shall post a vacancy notice on the bulletin boards where employee notices are usually posted for five (5) working days prior to filling the vacancy. All such notices shall contain a description of the position to be filled, including job duties, working hours, special qualifications required or desired, name and classification of immediate supervisor, location of reporting and working, and the deadline and place of application.
Section 8.2. The Employer will select the most qualified applicant. The Employer may consider the following criteria in selecting the most qualified applicant: experience; ability to perform the work; education; records of attendance and discipline; other qualifications including testing results; and seniority. If the qualifications of two (2) or more applicants are relatively equal, then the applicant with the most system seniority shall be selected.
Section 8.3. The Employer reserves the right to require involuntary reassignments within the same classifications, as needed.
Section 8.4. A copy of each vacancy posting will be provided to the Local President.
Section 8.5. Nothing in this Article shall be construed to limit or prevent the Employer from temporarily filling a vacant position for up to sixty (60) calendar days pending the Employer’s determination to fill the vacancy on a permanent basis. Additionally, nothing in this Article shall be construed to require the Employer to fill a vacant position.
Section 8.6. Nothing in this Article shall be construed to limit or prevent the Employer from hiring an individual that is not currently in the bargaining unit to fill a vacant position or assume a newly created position once the Employer has met its obligations under the contract.
Section 8.7. If a library branch site is established, personnel will be hired per Article 8 (Vacancies/Promotions). Employees may be reassigned to any Employer location per Section 8.3 for no longer than ninety (90) days. Further, the Employer has the right to designate one (1) employee as a “floater” who may be assigned to any site on a day-to-day basis without the restrictions above, and without the restriction in Section 8.3. A-1. Whenever vacancies arise or are anticipated during the school year, they shall be posted in the central office of each school building.
A-2. Whenever vacancies arise or are anticipated between the end of one school year and the beginning of the next, they shall be posted with a notice to all employees with their paychecks.
B. Vacancies will be filled on the basis of qualifications and ability without regard to sex, race, color or creed of the applicant.
C. Requests by a teacher for transfer to a different subject area, building or position for the next school year shall be made in writing to the Superintendent at any time. The teacher will set forth the reasons for transfer, position sought and qualifications.
VACANCIES/PROMOTIONS. A. Currently employed teaching personnel may, in the board’s discretion, be given first consideration in appointments of teaching positions.
B. Any employee seeking consideration or transfer to other teaching position must present his request to the Superintendent in writing. Personal conferences can be arranged.
VACANCIES/PROMOTIONS. A. Vacancies in all classes except maintenance, which shall occur from time to time due to retirement, death, resignation or other reasons, shall be given to employees on the basis of seniority if the employee can meet the posted qualifications. Promotions to vacancies in the maintenance class shall be filled on the bases of the seniority and the relative ability to perform the required responsibilities of the position. VACANCIES/PROMOTIONS. A. Except in emergency, not to exceed thirty (30) days, when a position covered by this agreement becomes vacant which represents a lateral transfer within a classification such vacancy shall be posted in a conspicuous place listing the pay, duties, and qualifications in the Office of the Executive Director of Human Capital Services and the Personnel Bulletin to be distributed to members of the Bargaining Unit. The notice of vacancy shall remain posted for seven (7) work days. Employees interested shall apply in writing within the seven day period.
B. At the expiration of the posting period the following factors in priority shall be used by the Superintendent or his/her designee after receiving a recommendation from the principal, if applicable, in selecting the employee for a lateral transfer:
1. Work history and performance.
2. Experience in related work.
3. Education and training related to the vacant position.
4. Seniority as measured by length of service within the School Department. In the event the Principal or Superintendent declines to approve a request for transfer under this article he/she shall state the reasons to the employee for not approving the request in writing. The candidate and the Union have the right to a meeting with the School Superintendent or his/her designee to discuss the concerns. The Superintendent will then render a decision in writing. If said employee is not satisfied with the outcome of the decision from the Principal/Superintendent, said employee shall have recourse through Article V and Article VI paragraphs A & B if applicable.
C. The successful applicant shall remain in the position for a minimum of one (1) year before becoming eligible to request a transfer. The one year restriction on bidding shall not apply to assignments made by the administration caused by a promotion.
D. The Department shall transfer or reassign the employee to the position no later than 30 working days following approval of the transfer by the Superintendent. The Union will receive notice within 15 working days of the approval of the transfer by the Superintendent.
VACANCIES/PROMOTIONS. A. For all vacancies in professional instructional, personnel, administrative or supervisory positions (including night school) caused by death, retirement, discharge, resignation or by the establishment of a new position or a vacancy which the School Board determines shall be filled the following procedures shall be followed: If a teachervacancyoccurs, such vacancy shall be posted on the bulletin board at the office of AMSACS and a copy shall be sent to the ▇▇▇▇▇▇▇ of the Union as soon as reasonably practicable. The vacancy notices shall set forth the minimum qualifications for the position, a description of the duties of the position, and the final date for filing applications to the extent practicable. Extra-Curricular Activities
(a) Employees shall be compensated for participating in any school- organized extra-curricular and school-organized athletic activities. Employee participation in all such activities shall be strictly voluntary.
(b) Whenever a vacancy occurs in any position in extra-curricular or athletic programs, such vacancy shall be posted on the bulletin board at the office of the AMSACS and a copy sent to the ▇▇▇▇▇▇▇ of the Union as soon as reasonably practicable. Notwithstanding the preceding sentence, it is expressly understood that the Executive Director, may continue to enter into individual arrangements with teachers to perform short term extracurricular activities for an agreed stipend without posting the opportunity because those one-off assignments are not “programs” within the meaning of the posting requirements herein. For example, assistance with course development would be one example of a one-off assignment and not a program.
B. The Board, or its designee, shall review all timely submitted applications before making its appointment. Nothing in this Agreement shall prevent the Board from making acting appointments until positions can be filled with permanent appointments as provided in this Agreement.
C. In the event a newly hired employee resigns prior to assuming his/her duties, an alternate applicant from the original posting may be appointed by the Executive Director for hire without re-posting the position as vacant.
VACANCIES/PROMOTIONS. 8.1 Vacancies and promotions shall be governed by the Rules and Regulations adopted by

The Superintendent shall post in the main office of each building, the teachers’ lounges and shall simultaneously send to the HEA president, notices of vacancies and promotional positions as they occur. Such notices shall include a statement of minimum qualifications, salary range, and the date by which the candidates must apply in writing. Such notices shall be posted or mailed at least ten (10) days prior to the application deadline. During the summer recess, the notices shall be 1) e-mailed to all staff members and 2) mailed to the summer address of the HEA president and to any Unit employee who has expressed a desire to receive them. One –time short –term and specific duty stipendiary and/or hourly employment opportunities approved by the Hopedale School Committee shall be made available to Unit C members, including but not limited to summer school, as they occur. In circumstances where certification or other specific qualifications are not required, Unit C members shall be given preferential consideration. The performance of the duties when selected or appointed to them shall be considered an extension of the employee’s regular duties as this is referred to in M.G.L. Ch. 268A, s. 1 and 20 (conflict of interest statutes).
