Utility Permit Applications. For reasons unrelated to a Utility Adjustment, it is anticipated that from time to time during the Construction Work, Utility Owners might apply for utility permits to install new Utilities that would cross or longitudinally occupy those areas of the Project that are subject to the Department’s permitting jurisdiction, or to modify, upgrade, relocate or expand existing Utilities within such areas. For such utility permit applications pending as of or submitted after the Effective Date, Developer shall assist the Department in its consideration of each utility permit application in accordance with the Contract Documents. Further, Developer shall make available upon request the most recent Project design information and/or As-Built Record Plans, as applicable, to the applicants, shall assist each applicant with information regarding the location of other proposed and existing Utilities, and shall use commercially reasonable efforts to coordinate work schedules with such applicants as appropriate to avoid interference with the Project Schedule by their activities.

Utility Permit Applications. For reasons unrelated to a Utility Adjustment, it is anticipated that from time to time during the Work, Utility Owners will apply for Utility permits to install new Utilities that would cross or longitudinally occupy those areas of the Project Right of Way that are subject to the Authority’s permitting jurisdiction, or to modify, upgrade, relocate or expand existing Utilities within such areas. For such Utility permit applications pending as of or submitted after the Financial Closing Date, Developer shall, as reasonably requested, assist the Authority in its consideration of each Utility permit application in accordance with the Project Documents. Further, Developer shall (a) make available upon request the most recent Project design information and/or As-Built Documents, as applicable, to the applicants; (b) assist each applicant, as reasonably requested, with information regarding the location of other proposed and existing Utilities; and (c) use Reasonable Efforts to coordinate work schedules with such applicants as appropriate to avoid interference with the Project Working Schedule by their activities.

  • Building Permit As soon as the Final Interior Plans have been approved by Landlord and Tenant, Landlord shall apply for a building permit for the Interior Improvements, and shall diligently prosecute to completion such approval process.

  • Building Permits All building permits required for the construction of the Improvements have been obtained prior to the commencement of the construction of the Improvements and copies of same will be delivered to Lessor.

  • Interconnection Facilities Engineering Procurement and Construction Interconnection Facilities, Network Upgrades, and Distribution Upgrades shall be studied, designed, and constructed pursuant to Good Utility Practice. Such studies, design and construction shall be based on the assumed accuracy and completeness of all technical information received by the Participating TO and the CAISO from the Interconnection Customer associated with interconnecting the Large Generating Facility.

  • Project Approvals Borrower will obtain in the ordinary course of business all Project Approvals not heretofore obtained by Borrower (being those listed and described on Part XII of the Project Schedules attached hereto as Exhibit A and any other Project Approvals which may hereafter become required or necessary) and will furnish Agent with evidence that Borrower has obtained such Project Approvals promptly upon its request. Borrower will give all such notices to, and take all such other actions with respect to, such Governmental Authority as may be required under applicable Requirements to construct the Improvements and to use, occupy, operate, and sell Units following the completion of the construction of the Improvements. Borrower will also obtain in the ordinary course of business all utility installations and connections required for the operation and servicing of the Projects for its intended purposes, and will furnish Agent with evidence thereof. Borrower will duly perform and comply with all of the terms and conditions of all Project Approvals obtained at any time, including all Project Approvals listed and described in Parts XII and XIII of the Project Schedules attached hereto as Exhibit A.

  • Applicable Permits Written confirmation that all Applicable Permits then required are in full force and effect including a list of such clearances.

  • COMPLIANCE WITH LAWS, LICENSES, PERMITS, AND INSURANCE POLICIES A. For each Term of this Agreement, Concessionaire shall obtain, pay for, maintain, and comply with all licenses, permits, certifications, authorizations, approvals, or any other documents required by all applicable government agency having jurisdiction over the Concession Premises or the conduct of Concessionaire's operations thereon. Concessionaire shall provide Department with written evidence that such applicable licenses, permits, authorizations, or other required documents have been obtained prior to commencement of the activity or operation covered by the license, permit, authorization, or other documentation. No operation shall begin until Concessionaire has provided such written evidence to Department.

  • Intellectual Property Rights in Construction Documents, Drawings, and Models The drawings, Specifications and other documents prepared by the Design Professional pursuant to this Contract (including, without limitation, the Construction Documents), are the property of the Owner, whether or not the Project for which they are made commences or completes construction. Neither the Contractor nor any Subcontractor or material or equipment supplier shall own or claim a copyright in such drawings, Specifications, and other similar or related documents; Owner shall retain all common law, statutory, and other intellectual property rights with respect thereto. The Contractor must deliver remaining copies of such documents to the Owner upon request or upon completion of the Work, except that the Contractor may keep one copy of such documents for its files. The Contractor shall only use such drawings, Specifications and other documents for this Project. Neither the Contractor nor any Subcontractor or material or equipment supplier may use such drawings, Specifications, and other documents on other projects without the specific written consent of the Owner. All models are the property of the Owner.

  • CONSTRUCTION/PUBLIC WORKS CONTRACTS In compliance with Article 8, Section 220 of the New York State Labor Law:

  • ENVIRONMENTAL DOCUMENTATION Each environmental service provided by the Engineer shall have a deliverable. Deliverables shall summarize the methods used for the environmental services, and shall summarize the results achieved. The summary of results shall be sufficiently detailed to provide satisfactory basis for thorough review by the State, The Federal Highway Administration (FHWA), and (where applicable) agencies with regulatory oversight. All deliverables shall meet regulatory requirements for legal sufficiency, and shall adhere to the requirements for reports enumerated in the State’s NEPA MOU.
