You agree to use the Test(s) and Q-global (a) in accordance with sections 3, 6, 7, and 8 of the Terms and Conditions referenced in Xxxxxxx’x then current published catalog and in accordance with all federal, state and local laws and regulations and (b) for the number of Administrations You have purchased from Pearson. You also agree to only use Q-global on computers that conform to Xxxxxxx’x then-current published computer operating environment specifications. You agree that Pearson may install any Q-global Maintenance Release at no additional charge. You understand and agree that Xxxxxxx’x Test(s) and Q-global are meant to be used as tools to supplement You in the overall assessment process, and are not intended or designed to be used alone or replace Your professional judgment. Use of psychological tests in employment-related situations may be subject to certain laws including Title VII of the Civil Rights Act of 1964, as amended; the Americans With Disabilities Act of 1990, as amended; and other federal, state, and local laws and regulations. You shall not grant sublicenses, assign or transfer (including transfer by rental) Q-global or use Q-global to benefit any third party without the prior written consent of Pearson.

Use of the Test. In three of the hospitals, the SelectMDx test was used prior to prostate biopsy for all patients with slightly elevated PSA levels, which is in line with what the test has been designed to do. One of these hospitals used the test in combination with an MRI scan. In six of the hospitals, the SelectMDx test was primarily used postbiopsy as a tool for selecting patients who needed another biopsy because there was continuing suspicion after negative prostate biopsy, in other words, when no prostate cancer had been identified during initial biopsy. In these cases, the urologists were using the SelectMDx test to confirm that the initial negative biopsies were indeed an indication of the absence of (a clinically significant form of) prostate cancer: "You have done biopsies and they do not show anything. Then you check the PSA again. It stays high, it goes up. Then you think: should I perform biopsies again? You want to have confirmation that your first biopsies, that did not show cancer, were correct." – HP19 The frequency of postbiopsy use of the SelectMDx test varied between hospitals. Some urologists regularly used the test after negative biopsy whereas others only used it occasionally. Even in hospitals where the SelectMDx test was used postbiopsy, it was common for not all urologists to use the test and there was no clear hospital policy on the use of the test: "Some do not use the SelectMDx test at all. And then you see three tests go out of the door on one day. There is such fluctuation. Well, I do not have the idea that they really have a clear policy here." – HP20 In some of the hospitals, tasks that are linked with the SelectMDx test, such as patient counseling, performing the test and data interpretation, were performed by the urologist, whereas in the other hospitals some of these tasks were delegated to the specialist nurse. Clinical decision-making It became clear that urologists used different cut-off points regarding the SelectMDx test results when they were making decisions about prostate biopsies. Only urologists from two of the hospitals, which both used the SelectMDx test prior to biopsy, used the 10% cut-off point, which was the aim of the developers of the test. In the other hospitals, the urologists mentioned higher cut-off points, ranging from 12 to 30% risk of clinically significant prostate cancer.   • ACCEPTANCE TESTS 11.1 If the Contract provides acceptance tests for Goods and/or the result of Services after their completion and/or delivery to the Purchaser, the acceptance shall only be considered as definitive when such tests have demonstrated the compliance of the Goods and/or the result of the Services to the requirements in the Contract.

  • Performance Testing 7.2.1 The Design-Builder shall direct and supervise the tests and, if necessary, the retests of the Plant using Design-Builder’s supervisory personnel and the Air Emissions Tester shall conduct the air emissions test, in each case, in accordance with the testing procedures set forth in Exhibit A (the “Performance Tests”), to demonstrate, at a minimum, compliance with the Performance Guarantee Criteria. Owner is responsible for obtaining Air Emissions Tester and for ensuring Air Emissions Tester’s timely performance. Design-Builder shall not be held responsible for the actions of Owner’s employees and third parties involved in the Performance Testing, including but not limited to Air Emissions Tester.

  • Random Testing Notwithstanding any provisions of the Collective Agreement or any special agreements appended thereto, section 4.6 of the Canadian Model will not be applied by agreement. If applied to a worker dispatched by the Union, it will be applied or deemed to be applied unilaterally by the Employer. The Union retains the right to grieve the legality of any imposition of random testing in accordance with the Grievance Procedure set out in this Collective Agreement.

The purpose of the on-site observations will be to observe the progress and quality of the construction work being carried on to determine if the work is proceeding in accordance with the Construction Documents. Unless otherwise stated in Exhibit A, the Consultant shall not be required to make exhaustive or continuous on-site observations to check the quality or quantity of the work.
