Common use of Use of the Term Clause in Contracts

Use of the Term. INFOMART". Landlord reserves the right -------------------------- to approve Tenant's usage of the term "INFOMART", and Tenant shall not use the term "INFOMART" in any of its activities (including advertising and marketing activities) without the prior written consent of Landlord. Copies of all proposed written materials and advertising containing references to the term "INFOMART" shall be furnished to Landlord in advance for its review and approval. Any permitted use of the term "INFOMART" by Tenant shall additionally include the phrase "The Technology Community" immediately after such use. Tenant shall not permit any third party to use the term "INFOMART" in any of its activities and shall report to Landlord any unauthorized uses of such term as it comes to its attention. The breach by Tenant of any provision in this Section 6.8 shall constitute an event of default under this Lease and shall entitle Landlord to exercise any right or remedy available to Landlord under this Lease, at law, or in equity. Tenant shall indemnify and hold Landlord harmless from and against any loss, cost, claim, liability, cause of action, or expense whatsoever (including attorney's fees and other costs and expenses of defending any such claim) arising or alleged to arise from any unauthorized use by Tenant, or any Tenant Related Party, of the term "INFOMART".

Landlord shall notify Tenant in writing after such proposed usage has been verified, and Tenant may thereafter commence such requested usage. Tenant shall not permit any third party to use the term "INFOMART" in any of its activities and shall report to Landlord any unauthorized uses of such term as it which comes to its attention. The breach by Tenant of any provision in provisions of this Section 6.8 8.3 shall constitute an event of default under this Lease and Tenant shall entitle Landlord to exercise cease and desist immediately from any right or remedy available to Landlord under this Lease, at law, or in equityunauthorized use within fifteen (15) days of Landlord's notice of such breach. Tenant shall indemnify and hold Landlord harmless from and against any loss, cost, claim, liability, cause of action, or expense whatsoever (including including, without limitation, attorney's fees and other costs and expenses of defending against any such claim) arising or alleged to arise from any unauthorized use by Tenant, or any Tenant Related Party, its agents or employees of the term "INFOMART".
