Use of Furniture. Upon execution of this letter agreement until the Payment Date, BoomBoat shall pay to Aucxis a monthly fee in the sum of $66.09 (the "Furniture Fee"), representing ten percent (10%) of the Furniture Purchase Price calculated annually. The Furniture Fee shall be paid and satisfied by BoomBoat in advance on first (1st) day of each <PAGE> -9- month by way of certified cheque or bank draft payable to the order of Aucxis or as it may otherwise direct in writing. 7.
Use of Furniture. Tenant’s right to use the Furniture as set forth in ¶ 8 of the First Amendment shall remain unchanged through the Expiration Date as extended hereunder.
Use of Furniture. Sublessee shall be permitted to use the furniture and equipment (“Equipment”) in the Subleased Premises throughout the term of the Sublease. The Equipment is delivered on an “AS IS – WHERE IS” basis, and Sublessor makes no representations or warranties as to said Equipment. An inventory of the Equipment is attached hereto as Exhibit D. Sublessee agrees to maintain and care for said Equipment throughout the Term of the Sublease at its sole cost and expense. Upon the expiration of this Sublease and payment by Sublessee to Sublessor of all amounts due hereunder, all ownership rights to Equipment that are vested in Sublessor at the time of such expiration shall be transferred to Sublessee.
Use of Furniture. With the exception of the First Amendment Excess Furniture, if any, during the First Amendment Term, at no charge to Subtenant, Subtenant shall be permitted to use the remaining existing modular and office furniture located in the First Amendment Expansion Space and described in more particular detail in Exhibit D attached hereto, as well as all equipment and associated data cabling existing in the First Amendment Expansion Space (the “First Amendment Furniture”). The First Amendment Furniture shall be considered part of the “Furniture” as such term is defined in Section 18.2 of the Sublease. Subtenant shall accept the First Amendment Furniture in its current condition without any warranty of fitness from Sublandlord (Subtenant expressly acknowledges that no warranty is made by Sublandlord with respect to the condition of any cabling currently located in or serving the First Amendment Expansion Space or with respect to the fitness of such cabling for Subtenant’s intend use thereof). For purposes of documenting the current condition of the First Amendment Furniture, Subtenant and Sublandlord shall, within ten (10) business days after Sublandlord’s receipt of the First Amendment Furniture Notice, conduct a joint walk-through of the First Amendment Expansion Space in order to inventory items of damage or disrepair. Subtenant shall use the First Amendment Furniture in accordance with Section 18.2 of the Sublease.
Use of Furniture. Subtenant shall have the right to use the furniture located within the Subleased Premises during the Term without charge, and shall return such furniture on the expiration or sooner termination of the Term in the same condition as received, reasonable wear and tear excepted.
Use of Furniture. From and after the Sublease Commencement Date, Sublessor hereby covenants and agrees that Sublessee shall have the right to use the furniture, equipment, workstations, telephone switch and handsets, chairs, file cabinets and other equipment located in the Subleased Premises owned by Sublessor (collectively, the “Furniture”), which Furniture is more particularly identified on Schedule 1 attached hereto and made a part hereof. Sublessee shall maintain such Furniture in its as is condition, subject to normal wear and tear and shall have the right to modify and/or rearrange the Furniture during the Term in accordance with the terms and provisions of the Prime Lease.
Use of Furniture. The permission granted to SHUSD by CITY shall include such furniture and fixtures as are presently at, or may in the future be provided by CITY for the Pool. SHUSD agree to indemnify CITY against damages to such furniture and fixtures caused by the acts of SHUSD, or its members, in excess of ordinary wear and tear. CITY shall designate how facility is to be used and where the furniture is to be stored.
Use of Furniture. Tenant shall have the right to use in the Premises the furniture that is owned by Landlord and is currently being used by Tenant in its premises located on the 5th Floor of the Building. All of such furniture shall continue to be owned by Landlord and Landlord is making no representation or warranty whatsoever, either express or implied, regarding such furniture. Tenant shall use such furniture at its own risk and shall surrender such furniture to Landlord upon the expiration or sooner termination of the Term of this Lease.
Use of Furniture. Subtenant may utilize the furniture and audio-visual equipment owned by Sublandlord and located in the Subleased Premises as of the Commencement Date (the “Furniture”) during the Sublease Term. The Furniture is itemized in Exhibit C attached hereto (the “Inventory”). If Subtenant elects not to use some or all of the Furniture, it may store the Furniture offsite, at Subtenant’s sole cost and expense, and risk of loss; provided, however that Subtenant may not remove any of the Furniture comprising audio-visual equipment. Provided that no Event of Default has occurred (as defined in Section 22), Sublandlord shall not remove the Furniture listed on the Inventory during the Sublease Term.
Use of Furniture. Tenant shall have the use of existing furniture in the Premises which are shown in Exhibit `A' attached. Tenant shall be responsible to return such furniture in good condition, normal wear and tear excepted. The furniture rental payment shall be $1.50 per square foot or $2,356.25 per month.
