USE OF ARCHITECT’S DRAWINGS, SPECIFICATIONS AND OTHER DOCUMENTS. 6.1 The drawings, specifications and other documents prepared by the Architect are the property of the Architect, who shall be vested with all common law, statutory, and other reserved rights provided; however, the Owner will indemnify and hold the Architect harmless in the event the Owner scribes unauthorized modifications or uses such documents for purposes other than this Project.
USE OF ARCHITECT’S DRAWINGS, SPECIFICATIONS AND OTHER DOCUMENTS. 7.1.All of the Contract Documents, all Drawings and Specifications and all other prints, models, drawings, designs, specifications, computations, sketches, test data, surveys, survey results, photographs, renderings, plans, shop and proposed drawings, computer data, other material relating to the Work, and other items covered by this Agreement and prepared by Architect or Architect’s Consultants (collectively, “Architect’s Materials”) shall from their inception become and be the property of Owner. Architect, for itself and any of Architect’s Consultants, hereby expressly waives any claim of ownership of or right to any of the Architect’s Materials, including without limitation, the ownership and/or right to the representation or expression thereof to which Architect might otherwise be entitled, and any lien or right of lien against any of the Architect’s Materials which Architect might otherwise have. Upon completion of the Project or at any earlier time at the request of Owner, Architect shall deliver to Owner all original tracings and CAD files made in connection with the Project, including but not limited to Drawings, Specifications and renderings (colored or otherwise). Architect shall retain a reproducible copy of each of such tracings and may retain a copy of computer data for purposes only of confirming performance of Architect’s Services. Owner shall indemnify and defend Architect from and against any liability which Architect may incur or suffer as a result of Owner’s use of the Architect’s Materials (other than the use of the unique aesthetic elements of the Architect’s Materials) on any project other than the Project. The foregoing indemnity shall not apply to Owner’s maintenance and repair of the Project or to any additions, alterations or future construction to the Project.

The Owner shall be permitted to retain copies, including reproducible copies, of the Architect's Drawings, Specifications and other documents for information and reference in connection with the Owner's use and occupancy of the Project. The Architect's Drawings, Specifications or other documents shall not be used by the Owner or others on other projects, for additions to this Project or for completion of this Project by others, unless the Architect is adjudged to be in default under this Agreement, except by agreement in writing and with appropriate compensation to the Architect.

The Architect shall be permitted to retain copies, including reproducible copies, of the Architect's Drawings, Specifications and other documents for information and reference in connection with the Owner's use and occupancy of the Project. The Architect's Drawings, Specifications or other documents shall not be used by the Owner or others on other projects.
USE OF ARCHITECT’S DRAWINGS, SPECIFICATIONS AND OTHER DOCUMENTS. § 6.1 All drawings, plans, specifications, renderings, models, special art work and other work provided as part of the Architect’s (and Architect’s Consultants’) services pursuant to this Agreement, (collectively referred to herein as “Drawings”) shall be the sole property of the Owner and all copyrights shall pass to Owner, whether the Project is executed or not, and shall not be used by any person other than the Owner on projects other than this Project unless expressly authorized in writing by the Owner. The Architect specifically agrees to incorporate the provisions of this Section in all contracts for the services of Architect’s Consultants. The Architect represents that it is the sole owner of the Drawing copyrights and the agent signing this Agreement is authorized to transfer exclusive copyright ownership to Owner. Owner agrees that Architect may retain the original set of the Drawings for record. Architect agrees that Owner, without paying Architect or any other entity any compensation other than the amounts due pursuant to this Agreement, shall have the right to (1) use the Drawings created by the Architect and the Architect’s Consultants and the ideas and designs contained therein for the completion and construction of the Project, Owner’s occupancy, use, maintenance and repair of the Project, and for additions, alterations or future construction to the Project, and/or (2) transfer ownership of the Drawings to the Agency or any assignee without paying Architect any compensation other than the amounts payable to Architect pursuant to this Agreement for services actually provided by Architect to Owner, or in the event of termination such amounts as are required by this Agreement as a result of such termination. Notwithstanding the foregoing, however, Architect (and its Consultants) shall continue to own the underlying design concepts set forth in the Drawings, including architectural details, systems arrangements, and shall have the right to use such concepts, details and arrangements in connection with the design of other projects without Owner’s consent. Owner agrees that if the Drawings are used by Owner to complete the construction of the Project without retaining Architect to provide further plans, specifications and other design documents articulating such work, or if Owner uses the Drawings on another project without retaining Architect to provide the design for such other project, then Architect shall not be responsible for, and Owner shal...
USE OF ARCHITECT’S DRAWINGS, SPECIFICATIONS AND OTHER DOCUMENTS. 6.1 The Owner is granted an irrevocable license to use the Drawings, Specifications and other documents prepared by Architect or its consultants/subconsultants for this Project and for future work at the property which is the site of the project, but not at any other location. The Architect shall not use or allow to be used the Drawings, Specifications and reports or the unique design aspects of this project for any other project, without the prior written approval of Owner. USE OF ARCHITECT’S DRAWINGS, SPECIFICATIONS AND OTHER DOCUMENTS. 6.1.1. The Drawings, Specifications, and other documents prepared by the Architect for the Project are the property of the Owner for Owner's use in connection with the Project and the improvements constructed with respect to the Project. However, the Owner will not utilize these documents in the construction of other projects without equitable compensation to the Architect. Nothing stated herein shall be deemed to prohibit the use by Owner of a similar component or design feature in another Project without compensation to the Architect. In the event of any unauthorized use of the Drawings or Specifications by Owner for projects other than the Project that is the subject of this Agreement, Owner agrees to indemnify Architect and hold it harmless from any loss or damage incurred by Architect arising solely from such unauthorized use.

Copies of complete or partially completed mylar reproducible, preliminary layouts, record drawings, sketches and other documents prepared pursuant to this Agreement shall be delivered to the COUNTY when and if this Agreement is terminated or upon completion of this Agreement, whichever occurs first. The ARCHITECT may retain one set of reproducible copies of the documents and these copies shall be for the ARCHITECT’S sole use in preparation of studies or reports for the COUNTY. The ARCHITECT is expressly prohibited from selling, licensing, or otherwise marketing or donating these documents, or using the documents in preparation of other work for any other client, without the prior express written permission of the COUNTY.
