Common use of USE OF ADVISER’S NAME Clause in Contracts

USE OF ADVISER’S NAME. The Manager will not use the Adviser’s name (or that of any affiliate, including the name “Xxxxxx Xxxxxxx”) in Trust promotional or sales related materials prepared by or on behalf of the Manager or the Trust without prior review and approval by the Adviser, which may not be unreasonably withheld or delayed. The Manager and the Trust agree that if this Agreement is terminated and the Adviser or an affiliate of the Adviser shall no longer be the adviser to the Portfolios, the Trust will change the name of the Portfolios to delete any reference to the name of the Adviser or that of any affiliate.
