Use of a Sub- or Co-Transfer Agent. Notwithstanding any other provision of this Agreement, it is expressly understood and agreed that you are authorized in the performance of your duties hereunder to employ, from time to time, one or more Sub-Transfer Agents and/or Co-Transfer Agents.
Use of a Card includes use of the Card number and other Card details, for example to carry out a Card Transaction over the telephone or use of a representation of a Card in a digital wallet.
Use of. “Herein.” Unless otherwise specified, the words “hereof,” “herein” and “hereunder” and words of similar import when used in this Agreement shall refer to this Agreement as a whole and not to any particular provision of this Agreement.
Use of. “Including”: The word “including”, when used in this Agreement and preceded or followed by any terms or conditions, is not to be construed as limiting in any way the terms or conditions that either precede or follow that word, and, in respect of the terms and conditions that follow that word is deemed to refer to all other terms and conditions that can reasonably fall within the broadest possible scope of such terms and conditions.
Use of the Software licensed hereunder may require third party software or hardware (including but limited to databases, operating systems and servers). Unless specifically licensed in the Master Agreement, this Agreement does not contain a license to use such additional materials.
Use of. Landlord" and "Tenant" . All the provisions hereof are to be construed as covenants and agreements as though the words imparting such covenants and agreements were used in each separate provision and paragraph hereof. The words "Landlord" and "Tenant" and the pronouns referring thereto, as used in this Lease, shall mean, where the context requires or admits, the persons named herein as Landlord and Tenant, respectively, and their respectively, and their respective heirs, legal representatives, successors and assigns, irrespective of whether singular or plural, masculine, feminine or neuter. It is agreed that the agreements and conditions in this Lease contained on the part of Tenant to be performed and observed shall be binding upon Tenant and its successors and assigns and shall inure to the benefit of Landlord and its successors and assigns; and the agreements and conditions in this Lease contained on the part of the Landlord to be performed and observed shall inure to the benefit of Tenant and its successors and assigns. Tenant agrees that at all times on and after the Commencement Date of this Lease the sole liability for performance of all Landlord's obligations hereunder shall be that of the owner from time to time of the leased premises and that such liability with respect to each owner shall exist only for breaches of Landlord's obligations committed during the period of his ownership.
Use of. “Issuer Information” in “Free Writing Prospectus.” Each Underwriter severally agrees that such Underwriter shall not include any “issuer information” (as defined in Rule 433) in any “free writing prospectus” (as defined in Rule 405) used or referred to by such Underwriter without the prior consent of the Partnership (any such issuer information with respect to whose use the Partnership has given its consent, “Permitted Issuer Information”); provided that (i) no such consent shall be required with respect to any such issuer information contained in any document filed by the Partnership with the Commission prior to the use of such free writing prospectus and (ii) “issuer information,” as used in this Section 4, shall not be deemed to include information prepared by or on behalf of such Underwriter on the basis of or derived from issuer information.
Use of. A. No usage during first or last ten (10) days of each school year.
Use of a Card constitutes a purchase of Goods from DCI. Title to the Goods and risk of loss will pass upon delivery of the Goods to the Customer at the Supply Point.
Use of. All employees shall be permitted to use sick leave in 1/2 or full day segments. All employees shall be permitted to use sick leave in the above segments for medical and dental appointments. Any abuse or patterned use of sick leave shall be just cause for disciplinary action.
