Upon Expiration. Following the expiration of the Term pursuant to Section 12.1, the following terms shall apply:

Upon Expiration. If Operator holds over and continues in possession of the Operations Areas after expiration or termination of this Agreement, Operator will be deemed to be occupying the Operations Areas at sufferance from month-to-month, without limitation on any of Authority's rights or remedies hereunder, subject to all of the terms and conditions of this Agreement. Similarly, if Operator continues to exercise its privilege of doing business at the Airport after expiration of the Term of this Agreement, other than provided above, Operator will be deemed to be conducting such business at the sufferance of Authority, without limitation on any of Authority’s rights or remedies hereunder, subject to all of the terms and conditions of this Agreement. In such event, Operator shall pay an amount equal to the then fair market rental for occupancy of the Operations Areas.
Upon Expiration. Upon expiration of this Agreement, in addition to the other rights and obligations of the Parties, SKINMEDICA shall have a paid-up, perpetual, exclusive license to use the Licensed Know-How with regard to the Licensed Product in the Field in the Territory as set forth in Section 2.1 (a) with no obligation of accounting or otherwise to DOW.
Upon Expiration. Upon the expiration of this Agreement, CHRP shall, without further consideration, assign its rights under any and all Sublicense Agreements to NGX.
Upon Expiration. If INTERIM SUPERINTENDENT is not selected to serve as the DISTRICT’S next Superintendent, the INTERIM SUPERINTENDENT shall be entitled to resume the position of the DISTRICT’s Chief Operations Officer effective January 2, 2022.
Upon Expiration. Upon expiration of this Agreement, with respect to a particular Licensed Product in a particular country, the licenses granted by Oxxxxxxxxx to Notable hereunder will become non-exclusive, fully paid-up, royalty free, perpetual licenses.
Upon Expiration. If Concessionaire holds over and continues in possession of the Assigned Area after expiration or termination of this Agreement, other than with the written consent of Authority, Concessionaire will be deemed to be occupying the Assigned Area at sufferance from month-to-month tenancy, without limitation on any of Authority's rights or remedies, subject to all of the terms and conditions of this Agreement. The Assigned Area rental shall be based on the same formula as the last month of the Term of the Agreement prior to the hold over but shall be double such amount. It is agreed and understood that any holding over of Concessionaire after the expiration or termination of this Agreement shall not renew and extend same, but shall operate and be construed as a license from month to month. Without any further notice other than the notice established by this provision, Concessionaire shall be required to pay to the Authority during any holdover period, monthly license fees which shall be equal to double the amount of the monthly payment of Privilege Fees that was due and payable for the month immediately preceding the expiration or termination of this Agreement. In addition, Concessionaire shall be required to pay to Authority any other charges required to be paid hereunder during any such holdover period. Concessionaire shall be liable to the Authority for all loss or damage on account of any such holding over against the Authority’s will after the termination or expiration of this Agreement, whether such loss or damage may be contemplated at the execution of this Agreement or not. It is expressly agreed that acceptance of the foregoing payments by the Authority in the event that Concessionaire fails or refuses to surrender possession shall not operate or give Concessionaire any right to remain in possession nor shall it constitute a waiver by the Authority of its right to immediate possession of the premises.
Upon Expiration. Following the expiration of the Term pursuant to Section 12.1, Medicis shall return to Anacor all Confidential Information of Anacor then in its possession. If the Term expires following Medicis’s exercise of the PoC Option, Medicis shall have, and Anacor hereby grants to Medicis, an exclusive, fully-paid (only upon such expiration) and royalty-free right and license, with the right to grant sublicenses, under the Anacor Exclusively Licensed IP to make, have made, use, sell, offer for sale, import and otherwise exploit the Medicis Development Compounds as and into Products in the Territory, for so long as it continues to do so.
Upon Expiration. Upon expiration of the license granted hereunder in accordance with Section 11.1 or Section 11.2 as to a particular feedstock, this Agreement shall continue to apply as to other feedstocks not subject to expiration. Upon expiration of this Agreement as to all feedstocks, the provisions of Articles 2, 6 (as to any Licensed Plants then in existence), and 9-13 and Sections 3.1 and 3.2 (as to any Licensed Plants then in existence), 3.3, 3.5, 3.8, 5.1, 5.3, 5.4, 8.4, 8.5, and 8.6 shall survive such expiration. Upon expiration of this Agreement as to any particular feedstock, this Agreement shall remain in full force and effect as to other feedstocks, and Article 6 shall remain in full force and effect as to any Licensed Plants then in existence based on the expired feedstock.
