Common use of UNSHIPPED GOODS AND MATERIALS Clause in Contracts

UNSHIPPED GOODS AND MATERIALS. Upon termination or expiration of this AGREEMENT, (i) BUYER shall purchase (a) any portion of unshipped GOODS, and/or (b) any portion of article(s), chemical or other component(s) or composition(s) at SELLER’s cost (as defined by GAAP) as of the date of termination or expiration in which case SELLER shall arrange for the prompt shipment to BUYER at the address(es) designated by BUYER, at BUYER’s expense.
