Unsafe Equipment. The Employer will not instruct an employee to operate any equipment which anyone in the exercise of ordinary care would reasonably know such operation might cause injury to the employee or anyone else. An employee shall not be subject to disciplinary action by reason of his/her failure or refusal to operate or handle any such unsafe piece of equipment. In the event that a disagreement arises between the employee and his/her supervisor concerning the question of whether or not a particular piece of equipment is unsafe, the appropriate District/Section Commander or designee shall be notified and the equipment shall not be operated until the appropriate District/Section Commander or designee has inspected said equipment and deemed it safe for operation. Employees shall not be disciplined for failure or refusal to engage in unsafe practices in violation of applicable federal, state, local or departmental safety laws or regulations. In the event that a disagreement arises between the employee and his/her supervisor concerning the question of whether or not a particular directive is unsafe, the appropriate District/Section Commander or designee shall be notified and said directive shall not be resumed unless the appropriate District/Section Commander or designee deemed the directive safe. The parties recognize the responsibility of members to carry out directives. Any question concerning the propriety of directives may be resolved in the grievance procedure.

Unsafe Equipment. No employee shall drive or operate a vehicle, machine or equipment that is unsafe or not properly equipped with safety equipment, nor a vehicle that is loaded over capacity for which it was designed as determined by state law. An employee will immediately notify the appropriate supervisor, appropriately tag such vehicle and file a work order. The immediate supervisor shall make the final determination as to the safety of the vehicle, machine or equipment.
Unsafe Equipment. The College will not knowingly instruct an employee to use or operate unsafe equipment. An employee shall not be subject to disciplinary action by reason of their failure or refusal to operate or handle any such unsafe equipment. If a disagreement arises between the employee and their supervisor concerning the condition of a particular piece of equipment, the Chief of Police/Designee shall be notified and the equipment shall not be used or operated until the Chief of Police/Designee has inspected said equipment and deemed it safe for operation. Any question concerning the propriety of policies/procedures may be resolved in the grievance procedure.
Unsafe Equipment. The Employer shall not require employees to operate any equipment that is not in safe operating condition or equipped with the safety appliances prescribed by law. It shall not be a violation of this Agreement where employees refuse to operate such equipment unless such refusal is unjustified.
Unsafe Equipment. The employee should report unsafe equipment to their supervisor. Unsafe equipment should be replaced or repaired prior to its use. Each employee should be trained on how to report unsafe equipment and supervisors will ensure all necessary repairs are made.
Unsafe Equipment. It will not be a violation of this Agreement when Employees refuse to operate unsafe equipment as prescribed by law. All unsafe equipment shall be locked out and red- tagged.

Unsafe Equipment. A. The Employer shall not require employees to take out on the streets or highways any vehicle that is not in safe operating condition or equipped with the safety appliances prescribed by law. If an employee refuses to operate said equipment without justification, said employee may be subject to disciplinary action, including discharge. "
