Unlisted uses. Where there is a question regarding the inclusion of a particular proposed use within a particular use category or use type, XXXX will make a determination. That determination will be forwarded in writing to the Director of the Department of Planning and Land Services who will have 14 days to notify XXXX of any disagreement with XXXX’x determination. In cases of disagreement, the matter will be forwarded to the Hearing Examiner who will have the final authority. The Hearing Examiner will either decide the matter and notify parties in writing or schedule the matter for public hearing.

  • Permitted Uses Tenant may use the Property only for the Permitted Uses set forth in Section 1.06 above.
