Grievances under this section shall be filed at the first formal level of the grievance process. If the allegations are against the employee’s immediate supervisor and the immediate supervisor is the first formal level, then the grievance may be filed at the next level of supervision.

Notwithstanding any prevailing precedence or case law, if it can be shown by a pre-ponderence of the evidence by a neutral third-party fact-finder (ie an arbitrator) that retaliation was a factor in an adverse employment action against a Union xxxxxxx, the Employer will be liable for compensatory and punitive damages unless it can show by a clear and convincing evidence that it had a legitimate, non- pretextual and non-retaliatory basis for the adverse employment action. The principles of agency shall be liberally construed, so that upper level managers will be held responsible for retaliatory intent of their subordinate supervisors.

  • Legal Protection 7.14.1 The University shall provide legal representation to any Member of the Bargaining Unit who is named a defendant in a civil action based on performance of the Member’s duties within the scope of employment. Legal representation will be at the Member’s request, subject to the approval of the Ohio Attorney General and in accordance with Ohio law.
