Common use of Unconditional Guaranty Clause in Contracts

Unconditional Guaranty. In consideration of the execution by Landlord of the Lease Agreement, Guarantor absolutely, irrevocably and unconditionally guarantees full and complete payment and performance by Resident of all of the duties and obligations of Resident under the Lease Agreement and further covenants with the Landlord that if default shall at any time be made by the Resident in payment of Rent or other payments under the Lease Agreement or in the performance of any other duties or obligations of the Resident contained in the Lease Agreement, Guarantor will pay to the Landlord or Landlord's successors or assigns any delinquent Rent and any damages or other sums that may arise or be due to Landlord under the Lease Agreement as a result of any violation or default by the Resident, on receipt of written notice of such violation or default from Landlord or Landlord's successors or assigns. Releasing or assignment of the Lease Agreement by Resident with or without Guarantor's approval shall not affect Guarantor's liability under this Guaranty. Subject to the terms and provisions hereof, modifications or amendments to the Lease Agreement or the Premises, or extensions or renewals of the Lease Term, or apartment reassignment during the Lease Term or Renewal Term, shall not affect Guarantor's liability under this Guaranty. Guarantor shall be liable for such modifications, amendments, extensions, renewals or changes to the Lease Agreement or Renewal Agreements.

Releasing or assignment of the Lease Agreement by Resident with or without Guarantor's approval shall not affect Guarantor's liability under this Guaranty. Subject to the terms and provisions hereof, modifications or amendments to the Lease Agreement or the Premises, or extensions or renewals of the Lease Term, or apartment reassignment during the Lease Term or Renewal Term, shall not affect Guarantor's liability under this Guaranty. Guarantor shall be liable for such modifications, amendments, extensions, renewals or changes to the Lease Agreement or Renewal Agreements. Notwithstanding the foregoing, with respect to any renewal or extension of the Lease Term, unless Guarantor agrees otherwise (a) any renewal or extension of the Lease Term shall not extend beyond August 15, 2027, and Guarantor shall only be liable under a renewal or extension of the Lease Term that is entered into between Landlord and Resident on or before such date, (b) in the event that the Rent or other payments by Resident under the Lease are increased during any such renewal or extension of the Lease Term, then during such renewal or extension of the Lease Term Guarantor shall only be liable for such Rent or other payments which were applicable during the original Lease Term.

In consideration of the execution by Landlord of the Lease AgreementResident Contract, Guarantor absolutely, irrevocably and unconditionally guarantees full and complete payment and performance by Resident of all of the duties and obligations of Resident under the Lease Agreement Resident Contract and further covenants with the Landlord that if default shall at any time be made by the Resident in payment of Rent or other payments under the Lease Agreement Resident Contract or in the performance of any other duties or obligations of the Resident contained in the Lease AgreementResident Contract, Guarantor will pay to the Landlord or Landlord's successors or assigns any delinquent Rent and any damages or other sums that may arise or be due to Landlord under the Lease Agreement Resident Contract as a result of any violation or default by the Resident, on receipt of written notice of such violation or default from Landlord or Landlord's successors or assigns. Releasing or assignment of the Lease Agreement Resident Contract by Resident with or without Guarantor's approval shall not affect Guarantor's liability under this Guaranty. Subject to the terms and provisions hereof, modifications or amendments to the Lease Agreement Resident Contract or the Premises, or extensions or renewals of the Lease Contract Term, or apartment reassignment during the Lease Contract Term or Renewal Term, shall not affect Guarantor's liability under this Guaranty. Guarantor shall be liable for such modifications, amendments, extensions, renewals or changes to the Lease Agreement Resident Contract or Renewal Agreements.

Unconditional Guaranty. In consideration Guarantor hereby agrees to be responsible for all rent, damages, and other payments of any kind due from Tenant under the Lease. This also applies to any successive renewal leases that may occur, including transfer leases if Tenant during the Lease Term or any renewal term transfers to a substitute Apartment Suite within the Community. Guarantor understands that rent is due on the first of each month and that late fees may occur under the terms and conditions of the execution by Landlord of the Lease Agreement, Lease. Guarantor absolutely, irrevocably and unconditionally guarantees full the prompt and complete payment and performance by Resident of all of the duties rent and obligations of Resident other charges due by Tenant under the Lease Agreement and further covenants with Lease. Guarantor understands that he or she may be contacted for payment if the Landlord entire amount of rent is not promptly paid as agreed in the Lease. Guarantor agrees that if default shall at any time be made by Tenant defaults in the Resident in payment of Rent rent or other payments under the Lease Agreement Lease, or in otherwise violates the performance of any other duties or obligations terms of the Resident contained in the Lease AgreementLease, Guarantor will pay to the Landlord or Landlord's successors or assigns any delinquent Rent rent and any damages or other sums that may arise or be due to Landlord under the Lease Agreement as a result of any violation or default by the Resident, on receipt of Tenant. Guarantor promises to make such payments within five (5) days after written notice of such violation or default demand from Landlord or Landlord's successors or assignsto Guarantor for payment. Releasing Any transfer or assignment of the Lease Agreement by Resident Tenant with or without Guarantor's ’s approval shall not release or otherwise affect Guarantor's ’s liability under this Guaranty. Subject to the terms and provisions hereof, modifications Modifications or amendments to the Lease Agreement or the Premisesextensions, or extensions or renewals of the Lease Termrenewals, or apartment reassignment during the Lease Term or Renewal Term, renewal term shall not release or affect Guarantor's ’s liability under this Guaranty. Guarantor shall be liable for such modifications, amendments, extensions, renewals or extensions or changes to the Lease. This Guaranty shall be a continuing and cannot be cancelled by Guarantor until all of Tenant’s obligations under the Lease Agreement or Renewal Agreementshave been fully satisfied. Guarantor waives notice of Xxxxxxxx's acceptance of this Guaranty.
