Common use of Unaudited Statements Clause in Contracts

Unaudited Statements. The unaudited consolidated balance sheet of Borrower and its Consolidated Subsidiaries as of September 30, 2007 and the related unaudited consolidated statements of operations and cash flows for the nine (9) months then ended, copies of which have been delivered to Administrative Agent, fairly present in all material respects, in conformity with GAAP applied on a basis consistent with the financial statements referred to in Section 3.5(a), the consolidated financial position of Borrower and its Consolidated Subsidiaries as of such date and their consolidated results of operations and cash flows for the nine (9) months then ended (subject to normal year end adjustments and the absence of footnote disclosures).

The unaudited consolidated balance sheet of Borrower and its Consolidated Subsidiaries as of September June 30, 2007 2015 and the related unaudited consolidated statements of operations and cash flows for the nine six (96) months then ended, copies of which have been delivered to Administrative Agentthe Initial Lenders, fairly present in all material respects, in conformity with GAAP applied on a basis consistent with the financial statements referred to in Section 3.5(a), the consolidated financial position of Borrower and its Consolidated Subsidiaries as of such date and their consolidated results of operations and cash flows for the nine six (96) months then ended (subject to normal year year-end adjustments and the absence of footnote disclosures).
