Common use of Trust Moneys Not Subordinated Clause in Contracts

Trust Moneys Not Subordinated. Notwithstanding anything contained herein to the contrary, payments from cash or the proceeds of non-callable U.S. Government Securities held in trust under Article 8 by the Trustee for the payment of principal of and interest on the Notes shall not be subordinated to the prior payment of any Senior Debt or subject to the restrictions set forth in this Article 12, and none of the Holders shall be obligated to pay over any such amount to the Company or any holder of Senior Debt or any other creditor of the Company.

Notwithstanding anything contained herein to the contrary, payments from cash money or the proceeds of non-callable U.S. Government Securities Obligations held in trust under Article 8 ARTICLE VIII by the Trustee for the payment of principal of premium, if any, and interest on the Notes Securities shall not be subordinated to the prior payment of any Senior Debt Indebtedness or subject to the restrictions set forth in this Article 12ARTICLE X, and none of the Holders Securityholders shall be obligated to pay over any such amount to the Company or Company, any holder of Senior Debt Indebtedness, or any other creditor of the Company.

Notwithstanding anything contained herein to the contrary, payments from cash money or the proceeds of non-callable U.S. Government Securities government obligations held in trust under Article 8 Section 11.3 by the Trustee for the payment of principal of and interest on the Notes Securities shall not be subordinated to the prior payment of any Senior Debt Indebtedness, or subject to the restrictions set forth in this Article 12Fifteen, and none of the Holders of Securities shall be obligated to pay over any such amount to the Company Company, or any holder of Senior Debt Indebtedness of the Company or any other creditor of the Company.

Notwithstanding anything contained herein to the contrary, payments from cash money or the proceeds of non-callable U.S. Government Securities Obligations held in trust under Article 8 Nine by the Trustee for the payment of principal of of, premium, if any, on and interest on the Notes Securities shall not be subordinated to the prior payment of any Senior Debt Indebtedness or subject to the restrictions set forth in this Article 12Seven, and none of the Holders shall be obligated to pay over any such amount to the Company or Company, any holder of Senior Debt Indebtedness of the Company, or any other creditor of the Company.

Notwithstanding anything contained herein to the contrary, payments from cash money or the proceeds of non-callable U.S. Government Securities Obligations held in trust under in accordance with Article 8 (and only so long as all of the conditions to the deposit into such trust were satisfied at the time of such deposit) by the Trustee for the payment of principal of and interest on the Notes Securities shall not be subordinated to the prior payment of any Senior Debt Indebtedness of the Company or subject to the restrictions set forth in this Article 1210, and none of the Holders Securityholders shall be obligated to pay over any such amount to the Company or any holder of Senior Debt Indebtedness of the Company or any other creditor of the Company.

Notwithstanding anything contained herein to the contrary, payments from cash money or the proceeds of non-callable U.S. Government Securities Obligations held in trust under Article 8 by the Trustee for the payment of principal of and interest on the Notes Securities shall not be subordinated to the prior payment of any Senior Debt Indebtedness or subject to the restrictions set forth in this Article 1210 if the deposit of such money was permitted by the Senior Indebtedness, and none of the Holders Securityholders shall be obligated to pay over any such amount to the Company or any holder of Senior Debt Indebtedness of the Company or any other creditor of the Company.
