Trust Agreements. The Trust Agreements of each of the Trust Funds as in effect on the date of this Agreement are incorporated herein by reference and made a part of this Agreement. Amendments to those Trust Agreements which are duly adopted after the date of this Agreement shall automatically be incorporated herein and made a part of this Agreement. Should any of the Trust Funds merge into or with another jointly-administered Trust Fund or Funds, then the Trust Agreement resulting as a consequence of that merger shall automatically be incorporated herein and made a part of this Agreement.
Trust Agreements. The individual Trust documents are part of this Agreement as if included herein, but may be amended during the term of this Agreement and such amendments when adopted by the parties shall also become part of the Agreement.
Trust Agreements. The Employer and the Guild agree to accept, assume and be bound by the separate Trust Agreements establishing the "Directors Guild of America–Producer Pension Plan" and "Directors Guild–Producer Health and Welfare Plan," and all modifications, alterations and amendments made thereto. The Employer shall, upon request, be furnished a copy of said Trust Agreements by the Plan Offices.
Trust Agreements. To ensure that the provisions of this Agreement can be enforced by the Executive, two agreements (“Trust Agreement” and “Trust Agreement No. 2”) dated as of February 10, 1989, have been established between National City Bank, a national banking association (“Trustee”) and the Company. The Trust Agreement sets forth the terms and conditions relating to payment from the Trust Agreement of the Severance Payment and other Employee Benefits pursuant to Section 5(a) hereof owed by the Company, and Trust Agreement No. 2 sets forth the terms and conditions relating to payment from Trust Agreement No. 2 of attorneys’ and related fees and expenses pursuant to Section 7(a) hereof owed by the Company. Executive shall make demand on the Company for any payments due Executive pursuant to Section 7(a) hereof prior to making demand therefor on the Trustee under Trust Agreement No. 2. Payments by such Trustee shall discharge the Company’s liability under Section 7(a) hereof only to the extent that trust assets are used to satisfy such liability.
Trust Agreements. The Port and the appropriate Unions adopt and shall be bound by the terms and conditions of such trust or trusts as set forth in the current area construction agreements. The action heretofore or hereafter performed by the Trustees of such trust or trusts are hereby adopted by the Port and the appropriate Unions. Fringe benefit contributions with the exception of pension as noted in C below, shall not be made on vacation hours paid or on holiday paid hours not worked. However, contributions shall be made on holiday hours worked.
Trust Agreements. At the discretion of the municipal officers, any revenue obligation securities issued under this subchapter may be secured by a trust agreement between the municipality and any corporate trustee or by a mortgage or other financial document. The trust agreement, mortgage, security agreement or other financial document may:
Trust Agreements. The Trust Agreement and Declaration of Trust for the Southern California Painters and Decorators Labor Management Cooperation Committee, dated July 1, 1994, shall be and hereby is incorporated herein to the same extent as if herein set forth in full and each and all provisions of said Agreement and Declaration of Trust shall be and hereby is binding on each and all parties hereto as if they had signed the same.
Trust Agreements. The applicable Trust Agreements (completed copies attached) shall be incorporated herein and deemed part of this Agreement as through fully set forth.
Trust Agreements. Each Individual Employer signatory or bound to this Agreement agrees to comply with and be bound by the various Trust Agreements creating the following trust funds and plans: Northern California Tile Industry Health and Welfare Trust Fund, Northern California Tile Industry Pension Trust Fund, Northern California Tile Industry Defined Benefit Pension Plan, Northern California Tile Industry Apprenticeship and Training Trust Fund, Tile Employers Contract Administration Fund, Northern California Tile Industry Labor Management Cooperation Committee and Tile Industry Promotion Fund of Northern California, Inc. Each Individual Employer hereby acknowledges receipt of the various Trust Agreements, as amended, or has been advised of the right to request copies of the Trust Agreements from the Trust Fund Administrator.
Trust Agreements. To ensure that the provisions of this Agreement can be enforced by the Employee, two agreements ("Amended and Restated Trust Agreement" and "Amended and Restated Trust Agreement No. 2") each dated as of March 26, 1991, as they may have been or may be amended, have been established between a Trustee selected by the members of the Compensation Committee or any officer (the "Trustee") and the Company. The Amended and Restated Trust Agreement sets forth the terms and conditions relating to payment pursuant to the Amended and Restated Trust Agreement of the Severance Amount, the Gross-Up Payment and other payments provided for in Section 3.5 hereof pursuant to this Agreement owed by the Company, and Amended and Restated Trust Agreement No. 2 sets forth the terms and conditions relating to payment pursuant to Amended and Restated Trust Agreement No. 2 of attorneys' and related fees and expenses pursuant to paragraph (a) of this Section owed by the Company. Employee shall make demand on the Company for any payments due Employee pursuant to paragraph (a) of this Section prior to making demand therefor on the Trustee under Amended and Restated Trust Agreement No. 2. Payments by such Trustee shall discharge the Company's liability under paragraph (a) of this Section only to the extent that trust assets are used to satisfy such liability.
