Common use of Trust Accounts Clause in Contracts

Trust Accounts. (a) On or prior to the Closing Date, the Issuer shall cause the Servicer to establish and maintain, in the name of the Indenture Trustee, for the benefit of the Noteholders and, to the extent set forth herein, the Certificateholder, the Collection Account as provided in Section 5.01 of the Sale and Servicing Agreement.

Trust Accounts. (a) On or prior to before the Closing Date, the Issuer shall cause the Servicer to establish and maintain, in the name of the Indenture Trustee, for the benefit of the Noteholders and, to and the extent set forth herein, the CertificateholderCertificateholders, the Collection Account as provided in Section 5.01 4.1(a) of the Sale and Servicing Agreement. On or before each Distribution Date, the Servicer shall deposit in the Collection Account all amounts required to be deposited therein with respect to the preceding Collection Period as provided in Section 4.2 of the Sale and Servicing Agreement.

Trust Accounts. (a) On or prior to the Closing Date, the Issuer shall, or shall cause the Servicer to to, establish and maintain, in the name of the Indenture Trustee, for the benefit of the Noteholders and, to the extent set forth herein, the Certificateholder, the Collection Account Trust Accounts as provided in Section 5.01 of the Sale and Servicing Agreement.

Trust Accounts. (a) On or prior to the Closing Date, the Issuer shall cause the Servicer to establish and maintain, in the name of the Indenture Trustee, for the benefit of the Noteholders and, to and the extent set forth hereinCertificateholders, the Certificateholder, the Collection Account Trust Accounts as provided in Section 5.01 5.05 of the Sale and Servicing Agreement.

Trust Accounts. (a) On or prior to the Closing Date, the Issuer shall cause the Servicer Indenture Trustee to establish and maintain, in the name of the Indenture Trustee, for the benefit of the Noteholders andand the Certificate Paying Agent, to on behalf of the extent set forth hereinCertificateholders and the Credit Enhancer, the Certificateholder, the Collection Payment Account as provided in Section 5.01 3.01 of the Sale and Servicing Agreementthis Indenture.

Trust Accounts. (a) On or prior to the Closing Date, the Issuer shall cause the Master Servicer to establish and maintain, in the name of the Indenture Trustee, for the benefit of the Noteholders and, to and the extent set forth hereinCertificateholders, the Certificateholder, the Collection Account Trust Accounts as provided in Section 5.01 of the Sale and Servicing Agreement.

Trust Accounts. (a) On or prior to the Closing Date, the Issuer shall cause the Servicer Administrator to establish and maintain, in the name of the Indenture Trustee, for the benefit of the Noteholders and, to and the extent set forth hereinTrust, the Certificateholder, the Collection Account Trust Accounts as provided in Section 5.01 2.3 of the Sale and Servicing Administration Agreement.

Trust Accounts. (a) On or prior to the Closing Date, the Issuer shall cause the Servicer to establish and maintain, in maintain the name of the Indenture Trustee, for the benefit of the Noteholders and, to the extent set forth herein, the Certificateholder, the Collection Account Trust Accounts as provided in Section 5.01 Sections 4.1 and 4.7 of the Sale and Servicing Agreement.

(a) On or prior to the Closing Date, the Issuer shall cause the Servicer Trust Depositor to establish and maintain, in the name of the Indenture Trustee, for the benefit of the Noteholders and, to and the extent set forth herein, Certificateholder the Certificateholder, the Collection Account Trust Accounts as provided in Section 5.01 5.05 of the Sale and Servicing Agreement.

Trust Accounts. (a) On or prior to the Closing Date, the Issuer shall cause the Servicer to establish and maintain, in the name of the Indenture Trustee, for the benefit of the Noteholders and, to in the extent set forth herein, the Certificateholder, case of the Collection Account and the Reserve Account, the Certificateholders, the Trust Accounts as provided in Section 5.01 of the Sale and Servicing Agreement.

Trust Accounts. (a) On or prior to the Closing Date, the Issuer shall cause the Servicer to establish and maintain, in the name of the Indenture Trustee, (i) for the benefit of the Noteholders andand the Certificateholders, to each of the extent set forth herein, Trust Accounts other than the Certificateholder, Negative Carry Account and the Collection Note Payment Account as provided in Section 5.01 Sections 4.1, 4.7 and 5.1 of the Sale and Servicing Agreement and (ii) for the exclusive benefit of the Noteholders, the Negative Carry Account and the Note Payment Account as provided in Sections 4.1(d) and 4.1(e) of the Sale and Servicing Agreement.

Trust Accounts. (a) On or prior to the Closing Date, the Issuer shall cause the Servicer Indenture Trustee to establish with the Paying Agent on its behalf and maintain, in maintain the name of the Indenture Trustee, Trust Accounts for the benefit of the Noteholders and, to the extent set forth herein, the Certificateholder, the Collection Account as provided in Section 5.01 of the Sale and Servicing Agreement.

Trust Accounts. (a) On or prior to the Closing Date, the Issuer shall cause the Servicer Administrator to establish and maintain, in the name of the Indenture Trustee, for the benefit of the Noteholders and, to the extent set forth hereinNoteholders, the Certificateholder, the Collection Account Trust Accounts as provided in Section 5.01 2.3 of the Sale and Servicing Administration Agreement.

(a) On or prior to the Closing Date, the Issuer shall cause the Servicer to establish and maintain, maintain with and in the name of the Indenture Trustee, for the benefit of the Noteholders and, to and the extent set forth hereinCertificateholders, the Certificateholder, the Collection Account Trust Accounts as provided in Section 5.01 of the Sale and Servicing Agreement.

Trust Accounts. (a) On or prior to the Closing Date, the Issuer shall cause the Servicer to establish and maintain, in the name of the Indenture Trustee, for the benefit of the Noteholders andand the Insurer, to or in the extent set forth hereinname of the Trust Agent, for the benefit of the Certificateholders and the Insurer, the Certificateholder, the Collection Account Trust Accounts as provided in Section 5.01 4.01 of the Sale and Servicing Agreement.

Trust Accounts. (a) On or prior to the Closing Date, the Issuer shall, or shall cause the Servicer to to, establish and maintain, in the name of the Indenture Trustee, for the benefit of the Noteholders and, to the extent set forth herein, the Certificateholder, the Collection Account Trust Accounts as provided in Section 5.01 5.02 of the Sale and Servicing Agreement.

Trust Accounts. (a) On or prior to the Closing Date, the Issuer shall cause the Servicer Administrator to establish and maintain, in the name of the Indenture Trustee, for the benefit of the Noteholders and, to and the extent set forth hereinSwap Counterparty, the Certificateholder, the Collection Account Trust Accounts as provided in Section 5.01 2(c) of the Sale and Servicing Administration Agreement.

(a) On or prior to the Closing Date, the Issuer shall cause the Servicer to establish and maintain, in maintain the name of the Indenture Trustee, for the benefit of the Noteholders and, to the extent set forth herein, the Certificateholder, the Collection Account Trust Accounts as provided in Section 5.01 Sections 4.1 of the Sale and Servicing Agreement.

(a) On or prior to the Closing Date, the Issuer shall cause the Servicer and, in the case of the Swap Counterparty Collateral Account, the Indenture Trustee, to establish and maintain, with the Indenture Trustee and in the name of the Indenture Trustee, for the benefit of the Noteholders and, to the extent set forth hereinNoteholders, the CertificateholderSwap Counterparties, and the Certificateholders, the Collection Account Trust Accounts as provided in Section 5.01 7.01 of the Sale Transfer and Servicing Agreement.

Trust Accounts. (a) On or prior to the Closing Date, the Issuer shall cause the Servicer Indenture Trustee to establish and maintain, in the name of the Indenture Trustee, for the benefit of the Noteholders and, to in the extent set forth herein, the Certificateholder, case of the Collection Account and the Reserve Account, the Certificateholders [and each Swap Counterparty], the Trust Accounts as provided in Section 5.01 of the Sale and Servicing Agreement.

(a) On or prior to the Closing Date, the Issuer or the Servicer, as applicable, shall cause the Servicer Securities Intermediary to establish and maintain, in the name of the Indenture Trustee, for the benefit of the Noteholders and, to in the extent set forth herein, the Certificateholder, case of the Collection Account and the Reserve Account, the Certificateholders, the Trust Accounts as provided in Section 5.01 of the Sale and Servicing Agreement.

Trust Accounts. (a) On or prior to the Closing Date, the Issuer shall cause the Servicer to establish and maintain, in the name of the Indenture Trustee, for the benefit of the Noteholders and, to and the extent set forth hereinCertificateholders, the Certificateholder, the Collection Account Trust Accounts as provided in Section 5.01 5.02 of the Sale and Servicing Agreement.

(a) On or prior to the Closing Date, the Issuer shall cause the Servicer to establish and maintain, in the name of the Indenture Trustee, for the benefit of the Noteholders and, to the extent set forth herein, the Certificateholder, the Holder of the Revolving Liquidity Note and the Swap Counterparty, the Collection Account and Payahead Account as provided in Section 5.01 of the Sale and Servicing Agreement.

Trust Accounts. (a) On or prior to the Closing Date, the Issuer shall establish or shall cause the Servicer to establish and maintain, in the name of the Indenture Trustee, for the benefit of the Noteholders and, to the extent set forth hereinNoteholders, the CertificateholderInsurer and Certificateholders, as applicable, the Collection Account Trust Accounts as provided in Section 5.01 5.1 of the Sale and Servicing Agreement.

Trust Accounts. (a) On or prior to the Closing Date, the Issuer shall cause the Servicer Indenture Trustee to establish and maintain, in maintain the name of the Indenture Trustee, for the benefit of the Noteholders and, to the extent set forth herein, the Certificateholder, the Collection Account Trust Accounts as provided in Section 5.01 of the Sale Transfer and Servicing Agreement.

Trust Accounts. (a) On or prior to the Closing Date, the Issuer shall cause the Servicer to establish and maintain, in the name of the Indenture Trustee, for the benefit of the Noteholders and, to the extent set forth hereinNoteholders, the CertificateholderCertificateholders and the Swap Counterparty, the Collection Account Trust Accounts as provided in Section 5.01 5.05 of the Sale and Servicing Agreement.

(a) On or prior to the Closing Date, the Issuer shall cause the Master Servicer to establish and maintainestablish, in the name of the Indenture Trustee, for the benefit of the Noteholders and, to and the extent set forth hereinCertificateholders, the Certificateholder, the Collection Account Trust Accounts as provided in Section 5.01 5.1 of the Sale and Servicing Agreement.

Trust Accounts. (a) On or prior to before the Closing Date, the Issuer shall cause the Servicer to establish and maintain, in the name of the Indenture Trustee, for the benefit of the Noteholders and, to and the extent set forth herein, the CertificateholderCertificateholders, the Collection Account as provided in Section 5.01 Section 4.1(a) of the Sale and Servicing Agreement. On or before each Distribution Date, the Servicer shall deposit in the Collection Account all amounts required to be deposited therein with respect to the preceding Collection Period as provided in Section Section 4.2 of the Sale and Servicing Agreement.

Trust Accounts. (a) On or prior to the Closing Date, the Issuer shall cause the Servicer to establish and maintain, in the name of the Indenture Trustee, (i) for the benefit of the Noteholders andand the Certificateholders, to each of the extent set forth herein, Trust Accounts other than the Certificateholder, the Collection Note Payment Account as provided in Section 5.01 Sections 4.1, 4.7 and 5.1 of the Sale and Servicing Agreement and (ii) for the exclusive benefit of the Noteholders, the Note Payment Account as provided in Sections 4.1(d) and 4.1(e) of the Sale and Servicing Agreement.

Trust Accounts. (a) On or prior to the Closing Date, the Issuer shall cause the Servicer to establish and maintain, in the name of the Indenture Trustee, for the benefit of the Noteholders and, to the extent set forth herein, the CertificateholderCertificateholder and the Swap Counterparty, the Collection Account as provided in Section 5.01 of the Sale and Servicing Agreement.

Trust Accounts. (a) On or prior to the Closing Date, the Issuer shall cause the Servicer or the Indenture Trustee, as applicable, to establish and maintain, in the name of the Indenture Trustee, for the benefit of the applicable Noteholders and, to the extent set forth hereinand Certificateholders, the Certificateholder, the Collection Account Trust Accounts as provided in Section 5.01 of the Sale Transfer and Servicing Agreement.

Trust Accounts. (a) On or prior to the Closing Date, the Issuer shall cause the Servicer to establish and maintain, in the name of the Indenture Trustee, for the benefit of the Noteholders and, to the extent set forth hereinNoteholders, the CertificateholderCertificateholders and the Counterparties, the Collection Account Trust Accounts as provided in Section 5.01 5.1 of the Sale and Servicing Agreement.

Trust Accounts. (a) On or prior to the Closing Date, the Issuer shall cause the Servicer to establish and maintain, in the name of the Indenture Trustee, for the benefit of the Noteholders and, to the extent set forth herein, the Certificateholder, [the Holder of the Revolving Liquidity Note] and [the Swap Counterparty], the Collection Account and Payahead Account as provided in Section 5.01 of the Sale and Servicing Agreement.

(a) On or prior to the Closing Date, the Issuer shall cause the Servicer to establish and maintain, in the name of or the Indenture Trustee, for the benefit of the Noteholders andas applicable, to establish and maintain the extent set forth herein, the Certificateholder, the Collection Account Trust Accounts as provided in Section 5.01 of the Sale Transfer and Servicing Agreement.

Trust Accounts. (a) On or prior to the Closing Date, the Issuer shall cause the Servicer to establish and maintain, in the name of the Indenture Trustee, for the benefit of the Noteholders and, to the extent set forth herein, and the Certificateholder, the Collection Account, the Note Distribution Account, the Reserve Fund, the Pre-Funding Account and the Capitalized Interest Account as provided in Section 5.01 7.01 of the Sale and Servicing Agreement.

(a) On or prior to the Closing Date, the Issuer shall cause the Servicer to establish and maintain, in the name of the Indenture Trustee, for the benefit of the Noteholders and, to and the extent set forth hereinCertificateholders, the Certificateholder, the Collection Account Trust Accounts as provided in Section 5.01 7.01 of the Sale and Servicing Agreement.

(a) On or prior to the Closing Date, the Issuer shall cause the Servicer to establish and maintain, in the name of the Indenture Trustee, for the benefit of the Noteholders and, to and the extent set forth herein, Certificateholders the Certificateholder, the Collection Account Trust Accounts as provided in Section 5.01 of the Sale and Servicing Agreement.

Trust Accounts. Distributions, (a) On or prior to the Closing Date, the Issuer shall cause the Servicer to establish and maintain, in the name of the Indenture Trustee, Trustee for the benefit of the Noteholders andNoteholders, to or on behalf of the extent set forth hereinOwner Trustee for the benefit of the Securityholders, the Certificateholder, the Collection Account Trust Accounts as provided in Section 5.01 of the Sale and Servicing Agreement. The Servicer shall deposit amounts into each of the Trust Accounts in accordance with the terms hereof, the Sale and Servicing Agreement and the Payment Statements.

Trust Accounts. (a) On or prior to the Closing Date, the Issuer shall cause the Servicer Trust Depositor to establish and maintain, in the name of the Indenture Trustee, for the benefit of the Noteholders Noteholders[,][ and, to ] the extent set forth herein, Certificateholder[s][ and the Certificateholder, [Swap][Cap] Counterparty,] the Collection Account Trust Accounts as provided in Section 5.01 5.05 of the Sale and Servicing Agreement.

(a) On or prior to the Closing Date, the Issuer shall cause the Servicer to establish and maintain, in the name of the Indenture Trustee, for the benefit of the Noteholders andand the Insurer, to or in the extent set forth hereinname of the Co-Owner Trustee, for the benefit of the Certificateholders and the Insurer, the Certificateholder, the Collection Account Trust Accounts as provided in Section 5.01 4.01 of the Sale and Servicing Agreement.
