Failure to fill in this report will bring disciplinary action. TRUCK MAINTENANCE AND SAFETY. (a) The Employer shall not require employees to take out on the streets or highways any vehicle that is not in safe operating condition or equipped with the safety appliances or stickers prescribed by law. It shall not be a violation of this Agreement where employees refuse to operate such equipment provided such refusal is justified. In the event an employee determines that a vehicle is in unsafe operating condition, the employee shall request that a supervisor confirm this. If the supervisor concurs, he shall place a red tag in a conspicuous place on the vehicle. Such vehicle shall not be operated until the fault is corrected. Nothing in this clause shall supersede the provisions of Section 128, Part II of the Canada Labour Code.

TRUCK MAINTENANCE AND SAFETY. 23.01 It shall not be a violation of this Agreement where employees refuse to operate any vehicle deemed unsafe in accordance with Linde policy and Ministry of Transportation legislation. However, it shall be the responsibility of the employee to immediately inform his Supervisor of such condition and to make the necessary arrangements to correct such problems.
