Transportation Documents. Customer shall deliver the Goods to the Facilities in a segregated manner, properly marked and packaged for handling. At or prior to delivery of the Goods, Customer shall furnish a manifest showing the Goods to be tendered for storage, with any instructions concerning storage, ancillary services, accounting, segregation, or any other requirements relating to the Goods. Customer agrees that if it fails to notify PCC Logistics in advance of the delivery of Goods then PCC Logistics shall have the right to refuse such Goods and shall not be liable or responsible for any loss, injury, or damage of any nature to, or related to, such Goods. If no instructions are provided by Customer to PCC Logistics, then PCC Logistics shall make its best judgment as to the proper storage of the goods and shall not be liable for any loss or damage caused thereby. Each shipment under this Agreement shall be evidenced by one or more transportation documents acceptable to PCC Logistics, which may include, but not be limited to, bills of lading, air waybills, ocean bills of lading, warehouse receipts manifests or any other documents purporting to control the custody and/or movement of the Goods (collectively, the "Transportation Documents"), showing the kind, quantity and condition of the Goods received and delivered by PCC Logistics or its Independent Contractors at the loading and unloading points, respectively. Except as provided herein, to the extent any term or condition of such Transportation Documents conflict in any way with any term or condition of this Agreement or the Appendices, this Agreement and the Appendices shall govern. In the event that PCC Logistics shall issue a through bill of lading to the ultimate destination, PCC Logistics shall be liable to Customer for loss or damage in accordance with the terms of this Agreement and the Appendices regardless of the number of separate contracts of carriage entered into by PCC Logistics with Independent Contractors if any.

Transportation Documents. The Principal shall supply the GSA with Air Waybill or Air Waybill serial number and other necessary documents (hereinafter referred to collectively as the “Documents”), to be utilized solely for the purposes of this Agreement. On shortage of Air Waybill stocks, the GSA should send written Air Waybill Stocks Request to the principal by means of fax or email. The Air Waybill Stocks Request should include items of GSA NAME, QUANTITIES REQUESTED and DATE OF REQUEST. On reception of the Air Waybill Stocks Request, the Principal should react to the request in writing by means of fax or email. The GSA should take stock of the Air waybill every month and send written Stock Report to the principal no later than 25th of the month by means of fax and email. Such Documents or Air Waybill serial number is and remains the property of the Principal and will be issued by the GSA only in compliance with the instructions of the Principal and in accordance with the provisions of this Agreement. All such Documents or Air Waybill serial number delivered to the GSA shall remain under its custody and care and the GSA shall be responsible for receiving the Documents from agents, when warranted. The Principal reserves the right to withdraw, at any time, any unused Documents. When authorized by the Principal, the GSA may issue Air Waybill for air transport offered by another carrier, in connection with the routes of the Principal. Upon the termination of this Agreement, the GSA shall immediately return to the Principal all unused AWB stock, as well as any other documents or other assets of the Principal in its possession, and shall render a complete accounting of all AWB stock. According to the regulation of Principal, the penalty for the loss of each international AWB is $1,000. The privy should be responsible for the loss which results from the blank bills missing.

In the event Axis issues a through xxxx of lading to the ultimate destination, Axis shall be liable to Customer for loss or damage only in accordance with the terms of this Agreement, regardless of the number of separate contracts of carriage entered into by Axis with Subcontractors, if any.

  • Construction Documents The architectural and engineering documents setting forth the design for the Project prepared by the Design Professional. Construction Documents include, but are not limited to, the Specifications, the Drawings, the Supplementary Conditions, the General Conditions, and all Addenda.

  • Construction Documents Phase Services 3.4.1 Based on the Owner’s approval of the Design Development Documents, and on the Owner’s authorization of any adjustments in the Project requirements and the budget for the Cost of the Work, the Architect shall prepare Construction Documents for the Owner’s approval. The Architect/Engineer will be responsible for managing the design to stay within such Guaranteed Maximum Price proposal or Amount Available for the Construction Contract. The Architect/Engineer shall review the Construction Documents as they are being prepared at intervals appropriate to the progress of the Project with the Owner and Construction Manager at the Project site or other location specified by Owner in the State of Texas. The Architect/Engineer shall utilize the model(s) to support the review process during Construction Documents. The Architect/Engineer shall provide the Construction Manager with a compact disc containing documents and data files derived from the model to assist the Construction Manager in fulfilling its responsibilities to the Owner.
