Transfers and Seniority Outside the Bargaining Unit. No employee shall be transferred to a position outside the bargaining unit without their consent. If an employee is transferred to a position outside of the bargaining unit, seniority acquired at the date of leaving the unit shall be retained for two (2) years, but no further accumulation shall occur. Should the employee return within two (2) years, this will not result in any layoff, bumping or reduction of hours of any employee(s).

If an employee is transferred to a position outside the bargaining unit, he/she shall retain his/her seniority accumulated up to the date of leaving the unit, but will not accumulate any further seniority while outside the unit.
Transfers and Seniority Outside the Bargaining Unit. (a) It is understood that an employee shall not be transferred by the Employer to a position outside the bargaining unit without his/her consent. In the case of a temporary assignment not exceeding eighteen (18) months, unless otherwise agreed to by the Employer and the Union, such employee on temporary assignment shall continue to accumulate seniority for the first six (6) months.

The employee shall have the right to return to the bargaining unit within twelve (12) months of the date that he left the bargaining unit to take the temporary vacancy and may return to the position he held immediately prior to leaving the bargaining unit. Upon his return to the bargaining unit, his seniority which he previously held shall be re-instated to the level that existed at the time he left the bargaining unit. The time limit may be extended upon mutual agreement amongst the parties.

If such an Employee returns to the bargaining unit within one (1) year, the Employee shall be placed in a job consistent with his seniority. Such return shall not result in the layoff or bumping of an Employee holding greater seniority. For temporary transfers seniority shall be retained and accumulated for six (6) months during which time union dues shall be paid. Extension may be granted by mutual agreement.

If an Employee is permanently transferred to a position outside of the bargaining unit, she shall retain her seniority accumulated up to the date of leaving the unit for a period of two (2) years from her date of transfer. If the Employee returns to the bargaining unit within two (2) years from her date of transfer, she shall be returned to her former position, if it exists, without loss of seniority. Any other Employee promoted or transferred because of the re-arrangement of positions shall also be returned to her former position, if it exists, without loss of seniority. If former positions, as referred to above, no longer exist, she shall be placed in a job consistent with her seniority. In this case, such placement shall not result in the layoff or bumping of an Employee holding greater seniority.

Transfers and Seniority Outside the Bargaining Unit. (a) An employee presently in the bargaining unit represented by the Union, who elects to transfer to a Non-Union position with the Hospital, outside of the bargaining unit, shall maintain her seniority earned while a member of the bargaining unit, and shall also be credited with full seniority acquired during the time she was employed outside the bargaining unit providing such position outside the bargaining unit does not extend for a period of time in excess of twelve (12) calendar months in the non-bargaining unit position. An Employee who consents in writing to be transferred and/or promoted to a position outside of the bargaining unit shall not accumulate seniority within the bargaining unit during such transfer and/or promotion. In the event that the Employee is returned by the Employer to a position in the bargaining unit within twelve (12) calendar months of the transfer and/or promotion, the Employee shall be credited with the seniority held immediately prior to the transfer and/or promotion and shall resume accumulation from the date of their return to the bargaining unit. An Employee not returned to the bargaining unit within twelve (12) calendar months from the transfer and/or promotion shall forfeit all bargaining unit seniority. In the event an Employee transferred and/or promoted out of the bargaining unit is returned to the bargaining unit within a period of six (6) calendar months from the start date of the transfer and/or promotion, the employee shall accumulate seniority during the period of time outside the bargaining unit.
