Common use of Transfer to Lower Paid Duties Clause in Contracts

Transfer to Lower Paid Duties. Where an employee is transferred to lower paid duties for reasons set out in sub-clause (a) hereof the employee shall be entitled to the same period of notice of transfer as he/she would have been entitled to if his/her employment had been terminated, and the Company may at the Company’s option make payment in lieu thereof of an amount equal to the difference between the former ordinary time rate of pay and the new lower ordinary time rates for the number of weeks of notice still owing.

Transfer to Lower Paid Duties. 15.2.1 Where an employee is transferred to lower paid duties for reasons set out in sub-clause (a) subclause 15.1.1 hereof the employee shall be entitled to the same period of notice of transfer as he/he or she would have been entitled to if his/his or her employment had been terminated, and the Company Employer may at the Company’s option Employer's option, make payment in lieu thereof of an amount equal to the difference between the former ordinary time rate of pay and the new lower ordinary time rates for the number of weeks of notice still owing.

Where an employee is transferred to lower paid duties for reasons set out in sub-clause (a) hereof subclause 29.2.1 above, the employee shall be entitled to the same period of notice of transfer as he/she the employee would have been entitled to if his/her the employee’s employment had been terminated, and the Company may employer may, at the Companyemployer’s option option, make payment in lieu thereof of an amount equal to the difference between the former ordinary time rate of pay and the new lower ordinary time rates for the number of weeks of notice still owing.

Where an employee is transferred to lower paid other duties for reasons set out in sub-clause (a) hereof 4.5.1 above, the employee shall be entitled to the same period of notice of transfer as hes/she he would have been entitled to if his/her employment had been terminated, and the Company may at the Company’s option 's option, make payment in lieu thereof of an amount equal to the difference between the former ordinary time rate of pay and the new lower ordinary time rates for the number of weeks of notice still owing.

Where an employee is transferred to lower paid duties for reasons set out in sub-clause paragraph (ai) hereof the employee shall be entitled to the same period of notice of transfer as he/he or she would have been entitled to if his/his or her employment had been terminated, and the Company employer may at the Company’s option employers option, make payment in lieu thereof of an amount equal to the difference between the employee's former ordinary time classification rate of pay and the new lower ordinary time rates classification rate for the number of weeks of notice still owing.

Where an employee is transferred to lower paid duties for reasons set out in sub-clause (a) Part F, 7..3.1 hereof the employee shall be entitled to the same period of notice of transfer as he/he or she would have been entitled to if his/his or her employment had has been terminated, and the Company employer may at the Companyemployer’s option option, make payment in lieu thereof of an any amount equal to the difference between the former ordinary time rate of pay and the new lower ordinary time rates for the number of weeks of notice still owing.

Where an employee is transferred to lower paid duties for reasons set out in Paragraph (a) of sub-clause (aii) hereof above, the employee shall be entitled to the same period of notice of transfer as he/she the employee would have been entitled to if his/her the employee's employment had been terminated, and the Company may employer may, at the Company’s option employer's option, make payment in lieu thereof of an amount equal to the difference between the former ordinary time rate of pay and the new lower ordinary time rates for the number of weeks of notice still owing.

Where an employee is transferred to lower paid duties for reasons set out in sub-clause (asubparagraph subclause B(i) hereof of this clause, the employee shall be entitled to the same period of notice of transfer as he/she the employee would have been entitled to if his/her the employee's employment had been terminated, and the Company employer may at the Company’s employer's option make payment in lieu thereof of an amount equal to the difference between the former ordinary time rate of pay and the new lower ordinary time rates rate for the number of weeks of notice still owing.

Where an employee is transferred to lower paid duties for reasons set out in sub-clause (a) subclause 2.3.2 hereof the employee shall be entitled to the same period of notice of transfer as he/she they would have been entitled to if his/her their employment had been terminated, and the Company employer may at the Company’s option employer's option, make payment in lieu thereof of an amount equal to the difference between the employee's former ordinary time classification rate of pay and the new lower ordinary time rates classification rate for the number of weeks of notice still owing.

Where an employee is transferred to lower paid duties for reasons set out in sub-clause (paragraph 29 a) hereof i) hereof, the employee shall be entitled to the same period of notice of transfer as he/he or she would have been entitled to if his/his or her employment had been terminated, and the Company employer may at the Companyemployer’s option option, make payment in lieu thereof of an amount equal to the difference between the former ordinary time rate of pay and the new lower ordinary time rates for the number of weeks of notice still owing.

Transfer to Lower Paid Duties. Where an employee is transferred to lower paid duties for reasons set out in sub-clause (a) hereof 24.1 hereof, the employee shall be entitled to the same period of notice of transfer as he/he or she would have been entitled to if his/his or her employment had been terminated, and the Company may company may, at the Company’s option its option, make a payment in lieu thereof of an amount equal to the difference between the former ordinary time rate of pay and the new lower ordinary time rates rate for the number of weeks of notice still owing.

Transfer to Lower Paid Duties. Where an employee is transferred accepts a transfer to a lower paid duties for reasons set out in sub-clause (a) hereof position, the employee shall be entitled to the same period of notice of transfer as he/she they would have been entitled to receive if his/her their employment had been terminated. Alternatively, and the Company employer, at their option, may at make a payment to the Company’s option make payment in lieu thereof of an amount affected employee(s) that is equal to the difference between the former ordinary time rate of pay and the new lower (lower) ordinary time rates rate for the number of weeks of notice still owing. This payment would be in lieu of notice requirements.
