Common use of Transfer outside of the Bargaining Unit Clause in Contracts

Transfer outside of the Bargaining Unit. (a) A nurse who has been requested to substitute temporarily in a classification that is excluded from the bargaining unit may refuse to do so. If she/he consents she/he shall be deemed to be covered by the Collective Agreement, but shall be compensated in accordance with the excluded classification. In the event that a nurse is transferred out of the bargaining unit, as above, for a period of three (3) months and is returned to a position in the bargaining unit, she/he will not suffer any loss of seniority, service or benefits. A nurse who is transferred temporarily to a position outside of the bargaining unit for a period of more than three (3) months but not more than one (1) year, with the option to extend if mutually agreed upon by both parties, shall retain but not accumulate, her or his seniority held at the time of the transfer. In the event the employee is returned to the bargaining unit, she/he shall be credited with seniority held at the time of the transfer and resume accumulation from the date of her or his return to the bargaining unit. Where the nurse is transferred temporarily for an employee who is off on pregnancy and/or parental leave, this temporary position can be extended to a maximum of eighteen (18) months.
