Common use of Transfer of Mortgage Loans Clause in Contracts

Transfer of Mortgage Loans. The Assignment of Mortgage is in recordable form, other than the assignee's name and recording information not yet returned from the recording office, and is acceptable for recording under the laws of the jurisdiction in which the Mortgaged Property is located. The transfer, assignment and conveyance of the Mortgage Notes and the Mortgages by NC Capital Corporation are not subject to the bulk transfer or similar statutory provisions in effect in any applicable jurisdiction;
