Transfer of Equipment. Grantor shall have the right to require that Grantee transfer to Grantor any equipment, including title thereto, purchased in whole or in part with Grantor funds, if Grantor determines that Grantee has not met the conditions of 2 CFR 200.439. Grantor shall notify Grantee in writing should Grantor require the transfer of such equipment. Upon such notification by Grantor, and upon receipt or delivery of such equipment by Grantor, Grantee will be deemed to have transferred the equipment to Grantor as if Grantee had executed a xxxx of sale therefor.
Transfer of Equipment. DHS shall have the right to require that Provider transfer to DHS any equipment, including title thereto, purchased in whole with DHS funds. DHS shall notify Provider in writing should DHS require the transfer of such equipment. Upon such notification by DHS, and upon receipt or delivery of such equipment by DHS, Provider will be deemed to have transferred the equipment to DHS as if Provider had executed a xxxx of sale therefor.
Transfer of Equipment. Customer shall provide prompt written notice to APLD if it transfers legal title to any Equipment to an entity, firm, or corporation that directly or indirectly, through one or more intermediaries, controls, is controlled by, or is under common control with Customer (the “Customer Affiliates”) or any other third party. In the event of such a transfer, Customer shall remain obligated to pay APLD the Monthly Service Fees for the transferred Equipment for the remainder of the Term unless and until such Equipment is placed into service under, and is subject to, a collocation agreement between the acquiring third party and APLD, which shall be at APLD’s sole discretion.
Transfer of Equipment. On the Service Agreement Effective Date, Wards shall assign, and Supplier shall assume, Wards' obligations under the applicable leases for the equipment listed on Exhibit E (the "Transferred Equipment. Transfer of Equipment. For any Provider Equipment that was used to provide Services at the time of notice of termination or expiration of this Agreement and/or to provide to Termination Assistance Services, Provider shall allow Company or its designee to (a) purchase, at fair market value at the time of Company’s purchase, any equipment supplies, tools or equipment owned by Provider that is used primarily or exclusively to provide the terminated Services; and/or (b) assume the lease of any equipment leased by Provider. Following the Termination Assistance Services period, each Party shall return to the other Party any assets owned by such other Party to which it is not given ongoing rights as part of the termination plan.
Transfer of Equipment. Seller does hereby sell, bargain, transfer, convey and deliver to Buyer all of Seller’s rights, title, claims and interest in and to the Assets and, including without limitation all warranties and any rights against the manufacturers or component manufacturers of the Equipment.

Transfer of Equipment. Equipment must be used for the approved purpose for five years, unless written permission is given by the AOC. After five years, the equipment may be transferred upon approval of the presiding judge of the court.

Transfer of Equipment. IR and Purchaser shall cooperate as reasonably required, so that the parties can fulfill their respective obligations and responsibilities under this Agreement. In particular, IR and Purchaser shall consult and coordinate so that the transfer of the Equipment shall be timed and effectuated in such a manner as to attempt to minimize the interruption of applicable production, taking into consideration Purchaser’s production scheduling and other sources of production available to Purchaser.
