TRANSFER CRITERIA. Transfer applications are considered on an individual basis without regard to sex, race, national origin, religion, disability, or ancestral language. In making transfer decisions, the Superintendent, as the Board’s designee, may consider grades, achievement test scores, attendance, disciplinary history, class sizes, available resources, and any potential adverse effect on resident students or program availability, as that term is defined in District policy FDA(LOCAL).
TRANSFER CRITERIA. 11.2.1 Whenever a transfer is being considered, voluntary or involuntary, it will be reviewed and assessed by administration based on the following:
TRANSFER CRITERIA. All transfers will be considered on the basis of securing the best guidance service. In the event that two (2) or more candidates are deemed equally qualified in terms of education, training, and experience, seniority shall prevail.

The “Treatment Hospital with Approved Pediatric Transfer” or “Transfer Hospital” agrees that, for the purposes of this Agreement, the Pediatric Sexual Assault Survivors who require transfer to “Treatment Hospital” for further evaluation of sexual assault or abuse are those who meet the following criteria: • Require subspecialty medical or surgical care which may include but not be limited to genitourinary, obstetrics, surgery, neuro, child life, social work or child protective team; and/or • An acute medical forensic exam. The Participating Hospitals also agree that, for the purposes of these Transfer Criteria, “pediatric” means the following: • Any survivor less than 13 years of age. • An individual with a disability does not change the applicability of the above criteria. The Participating Hospitals further agree that pediatric patients may require an acute medical forensic exam if one or more of the following exist: • Physical findings concerning for acute sexual assault/abuse, including signs of genital trauma or bleeding; • A complaint of sexual assault/abuse by an individual within a minimum of the past 7 days; • A complaint of past sexual assault/abuse by a specific individual and was in the care of that individual within a minimum of the last 7 days; or • Anyone that presents requesting additional services or requesting transfer.

The Transferring Hospital agrees that, for the purposes of this Plan, the pediatric patients who may require transfer to (Hospital) for further evaluation of sexual abuse are those who meet the following criteria: • Require subspecialty medical or surgical care; and/or • May require an emergent pediatric medical forensic exam. The Participating Hospitals also agree that, for the purposes of these Transfer Criteria, “pediatric” means the following: • Female—less than 13 years of age; and • Male—less than 13 years of age; and • Developmental delay does not change the applicability of the above criteria. The Participating Hospitals further agree that pediatric patients who may require an emergent pediatric medical forensic exam have one or more of the following: • Physical findings concerning for acute sexual abuse or assault, including signs of genital trauma or bleeding; • A disclosure of sexual assault/abuse by an individual within the past 7 days; • A disclosure of past sexual assault/abuse by a specific individual and was in the care of that individual within the past 7 days.
TRANSFER CRITERIA. In the determination of requests for voluntary transfer, for a posted, 580 open position, the wishes of the individual employee shall be honored to the extent that 581 the employee meets the minimum qualifications for the job as specified in the position 582 posting and is the most qualified of the persons requesting the position. No such 583 requests shall be denied arbitrarily, capriciously, or without basis in fact and shall be 584 done in writing. If an employee’s request for transfer has been denied, a renewed or 585 subsequent request made in the following school year shall be granted under the 586 conditions described above, unless there is no available position to which the employee 587 can be transferred. The employee with the most seniority shall receive the transfer, 588 assuming that all have equal qualifications. 589 590 SECTION 8 – INVOLUNTARY TRANSFERS 591 592 8.1 Use of Voluntary Requests: 593 No vacancy shall be filled by means of involuntary transfer if there is a qualified 594 volunteer available to fill the said position. 596 Notice: 595 597 If notice of an involuntary transfer is necessary, then an employee’s area of competence, 598 length of service in the District, length of service in the particular school building, and 599 other relevant factors, including, among other things, state and/or federal laws, rules, 600 regulations or administrative directives, shall be considered in determining which 601 employee is to be transferred. 602 603 Meeting and Appeal: 604 An involuntary transfer shall be made only after a meeting between the employee 605 involved and the immediate supervisor, at which time the employee shall be notified of 606 the reason therefore. In the event that an employee objects to the transfer at this 607 meeting, upon the request of the employee, the Superintendent shall meet with him/her. 608 The employee may, at their option, have an Association representative present at such 609 meeting. The District may, at its option, have more than one person present at such 610 meeting. 611 612 Involuntary Transfer Priorities: 613 A list of open positions in the School District shall be made available to all employees 614 being involuntarily transferred. Such employees may request the positions, in order of 615 preference, to which they desire to be transferred. Additionally, the District will consider student attitude, effort, academic progress, attendance records, discipline history, school involvement, and parent involvement.
TRANSFER CRITERIA. When two or more current employees apply for and are qualified for a position declared vacant by the District, the following criteria will be considered: experience, training, and seniority. Special qualifications, personal skills, teaching credentials, and special needs of the district will also be considered prior to completing the selection process. The basic criteria for all transfers and reassignments shall be the preferences of the employee and the needs of the District.
