Transaction Limitations. The Credit Union will permit a withdrawal only if you have sufficient available funds in your account to cover the full amount of the withdrawal or have an established overdraft protection plan. Insufficient balances on your account may result from 1) checks, 2) automated clearing house (ACH) debits such as online bill payment transactions, 3) payments authorized by an owner or other withdrawal requests, 4) items deposited by an owner and returned unpaid by the paying institution, and 5) imposition of service charges. Checks and ACH debits may be presented to us in batches or data files, and are paid when we process the data file. Checks from the same account in the same data file are processed in check number order. Checks presented for payment to one of our tellers at one of our branches are processed at the time of payment. Debit card transactions are processed when they are transmitted to us, which may occur at the time of the transaction or up to several days later. The merchant or its processor determines when the transaction will be transmitted to us. When a merchant obtains authorization for a debit card transaction, we place a temporary hold against the funds in the account for the amount of the authorized transaction. In some cases, such as restaurants, gas stations, or car rental transactions, there may be a hold for an initially authorized amount, but the transaction is submitted at a different amount. You should be certain there are enough funds in your account at all times to pay checks or other transactions you authorize, or those checks or transactions will be handled according to the overdraft and insufficient funds terms of this Agreement, or paid under one of our check overdraft services if applicable. You agree that we may change these practices at any time without prior notice to you to address data processing constraints, changes in law, regulation, clearing house rules or business concerns Determination of Available Balance to Pay Items. Checks and other transactions on your account are paid based on your available balance, and not the actual balance. Your actual balance is the amount of funds in the account at a point in time based on transactions that have posted to the account at that time. Your available balance is the amount of funds in the account that are available to pay checks, ACHs, and other items presented against the account without incurring an overdraft or non-sufficient funds fee or transferring funds from another account. The available balance is generally equal to the actual balance, less the amount of any holds placed on recent deposits, holds placed for other reasons, and holds for pending transactions (such as debit card purchases) that we have authorized but that have not yet posted to your account. If an item presented for payment against your account exceeds the available balance, we will treat it as presented against non-sufficient funds even if the actual balance exceeds the amount of the item.

In addition to the foregoing, if any person should instruct the Credit Union loan to make a large cash withdrawal (the definition of which shall be within the Credit Union's sole discretion) in lieu of other methods of transferring funds offered by the Credit Union, the Member hereby releases the Credit Union from any and all liability, claims and demands whatsoever which arise from or in any way relate to the Member's possession of any large sums of cash from the moment possession of same is made available to the Member; and Member will execute and deliver any further releases the Credit Union may require in connection with any such withdrawal. You may make unlimited withdrawals or transfers by mail, ATM (if available) or in person from Money Market Accounts. You may not, however, make more than a total of six transfers to other accounts or to third parties during each monthly statement period when these are made by pre-authorized or automatic agreement or telephone transfer. We reserve the right to prevent transfers which exceed the above limits or to monitor these transactions after they occur. When we observe that the number of transactions exceeds the above limits, we may contact you for corrective action. If excessive transactions continue to occur, we reserve the right to close your Account, convert it to an Account without transfer limitations, or assess a fee. Transaction Limitations and the Credit Union's Business Days. Except as may be otherwise specifically provided in our Agreements, all Transactions after our "daily cut-off time" and made on timedays that are not our business days as set forth in the Schedule will be treated, transmitted, recorded, etc., as applicable and appropriate as if received on the next business day that we are open. Deposits, orders, instructions, requests, etc., received by mail, electronically, at an unstaffed facility, or outside depository will be processed and credited only when actually received by us, and we shall have no responsibility until we actually receive the item. STOP PAYMENTS You may stop payment on a withdrawal order or on any check, except for cashiers' checks, official checks or other cash equivalent items. We must receive your stop payment order at a time and in a manner which gives us a reasonable opportunity to act on it prior to payment of the item. A VERBAL STOP PAYMENT ORDER IS VALID FOR ONLY 14 DAYS, UNLESS WE RECEIVE A WRITTEN CONFIRMATION THEREOF. A WRITTEN STOP PAYMENT ORDER ON A CHECK THAT IS NOT CONVERTED TO AN ACH TRANSACTION IS VALID FOR ONLY SIX MONTHS UNLESS IT IS RENEWED BY YOU. FOR ALL OTHER TRANSACTIONS, STOP PAYMENT ORDERS DO NOT EXPIRE. We will accept stop payment orders issued by any person with signing authority on your Account, regardless of who initiated the check or other withdrawal order, and even if more than one signature is required on a check or withdrawal order. Stop payment orders are subject to our current charge for that service. You may place a stop payment order at any branch office, by calling us at the telephone number on your statement, by writing to us at the address shown on your statement, or by any other notice method we agree to honor. We will request information about the check or other withdrawal order to be stopped, which may include but is not limited to: • Account number • Date • Name of party to be paid • Check number • Amount • Your name and address STOP PAYMENT ORDERS ARE PROCESSED BY COMPUTER. UNLESS THE AMOUNT OF THE ITEM AND OTHER INFORMATION ARE REPORTED ABSOLUTELY ACCURATELY, WE CANNOT ASSURE YOU THAT THE ITEM YOU WANT STOPPED WILL NOT BE PAID. In the event that we inadvertently pay an item over your valid stop payment order, we may refuse to re-credit your Account if you owed the money to the payee(s). You will be advised of the reasons for refusal if such action is taken. In generalYou may withdraw or transfer funds from your account(s) in any manner we permit (e.g., we pay checks and other transactions at an automated teller machine, in person, by mail, Internet access, automatic transfer, or telephone, as applicable), however, in the Share/savings account(s), you may make no more than six (6) transfers and withdrawals from your account to another account of yours or to a third party in any month by means of a preauthorized, automatic, or Internet transfer, by telephonic order in which they are presented to us for paymentor instruction, regardless of when or by check, draft, debit card or similar order. Checks and ACH debits may To be presented to us in batches binding, the order must accurately describe the ACH, check or data filesdraft, including the exact account number, the ACH, check or draft number, if applicable, and are paid when we process the data file. Checks from the same account in the same data file are processed in check number order. Checks presented for payment to one of our tellers at one of our branches are processed at the time of payment. Debit card transactions are processed when they are transmitted to us, which may occur at the time of the transaction or up to several days later. The merchant or its processor determines when the transaction will be transmitted to us. When a merchant obtains authorization for a debit card transaction, we place a temporary hold against the funds in the account for the exact amount of the authorized transactionACH, check or draft, the ACH order must also be in writing, dated and signed. This exact information is necessary for the Credit Union's computer to identify the ACH, check or draft. If we receive incorrect or incomplete information, we will not be responsible for failing to stop payment on the check or draft. In some casesaddition, such as restaurantswe must receive sufficient advance notice of the stop payment order to allow us a reasonable opportunity to act on it. If we re-credit your account after paying an ACH, gas stationscheck or draft over a valid and timely stop payment order, you agree to sign a statement describing the dispute with the payee, to assign to us all of your rights against the payee or other holders of the ACH, check or draft, and to assist us in any legal action. Duration of Order Written stop payment orders for checks or drafts are effective for six (6) months and may be renewed for additional six (6) month periods by requesting in writing that the stop payment order be renewed within a period during which the stop payment order is effective. We are not required to notify you when a stop payment order expires. Liability Fees for stop payment orders are set forth in the Truth-in-Savings Disclosure or Schedule of Fees and Charges. You may not stop payment on any certified check, cashier's check, teller's check, or car rental transactionsany other check, there draft, or payment guaranteed by us. You agree that we may change these practices at any time without prior notice to you indemnify and hold the Credit Union harmless from all costs, including attorney's fees, damages, or claims related to address data processing constraintsour refusing payment of an item, changes in law, regulation, clearing house rules or business concerns Determination of Available Balance to Pay Items. Your actual balance is the amount of funds in the account at a point in time based on transactions that have posted to the account at that time.
