To the Settlement Administrator Sample Clauses

To the Settlement Administrator. The Settlement Administrator will pay out of the Gross Settlement Amount to itself its reasonable fees and expenses that are documented and approved by the Court in an amount not to exceed $20,000 (“Settlement Administration Expenses”). To the extent the Settlement Administration Expenses that are documented and approved by the Court are less than $20,000, the remainder will be retained in the Net Settlement Amount for distribution to Participating Class Members.

To the Settlement Administrator. The Parties agree to pay a Settlement Administrator chosen by Class Counsel and approved by Defendants for its reasonable fees and expenses related to administering this Settlement, including, but not limited to, printing, distributing, and tracking forms for this Settlement, calculating estimated amounts per Class Member, tax reporting, distributing all payments from the Gross Settlement Amount (as adjusted), and providing necessary reports and declarations, and other duties and responsibilities set forth herein to process this Settlement, as requested by the Parties. The amount paid to the Settlement Administrator for its reasonable fees and expenses will be paid out of the Gross Settlement Amount. Every effort will be undertaken to minimize this cost and the Settlement Administrator will ensure proper notice and administration of the fund.
To the Settlement Administrator. Defendant will pay up to a total amount not to exceed $200,000.00 for Administration Costs. If the Administration Costs (reasonable fees and expenses) exceed $200,000.00, the Settlement Class and Class Counsel may authorize payment from the Settlement Fund of these additional Administration Costs (reasonable fees and expenses) to the Settlement Administrator as xxxxxved by Senior Judge Xxxxxx.
