Common use of Title to the Properties Clause in Contracts

Title to the Properties. The Borrower shall warrant and defend against the claims of all Persons whomsoever (i) its title to the Mortgaged Property and every part thereof and (ii) the validity and priority of the Lien of the Mortgage, subject only in each case to Liens permitted under the Loan Documents (including Permitted Encumbrances).

Title to the Properties. The Each Borrower shall will warrant and defend against the claims of all Persons whomsoever (i) with respect to its title to the Mortgaged each Property and every part thereof and (ii) the validity and priority of the Lien of the Mortgage, subject only in each case to Liens permitted under the Loan Documents (including Permitted Encumbrances)) and will provide notice to Lender of any title defects or claims made under any title insurance policy insuring Borrowers’ interests in the Properties.
