Title Report and Survey. (a) Within fifteen (15) days after the Effective Date (defined below), Seller, at its sole cost and expense, will deliver or cause to be delivered to Purchaser the following:

If Buyer desires Extended Coverage, Buyer may, at its sole expense, update or supplement the Survey or replace it with a new Survey, so long as it obtains such updated, supplemental or replacement Survey, and delivers a copy of it to Seller, at least ten (10) days before the Approval Date.
Title Report and Survey. Buyer agrees to procure at its own expense within forty-five (45) days of the date hereof a title commitment for an owner's title insurance policy at regular rates issued by a title insurance company licensed to transact business in the State of New Jersey in an amount not greater than the contemplated Purchase Price, insuring fee simple absolute title to the Complex, and to use reasonable efforts also to procure within such period a Survey of the Complex. Buyer shall give written notice to Seller of any objection to title within forty- five (45) days from the date of this Agreement. Buyer shall not object to liens for real estate taxes and assessments not due on or before the Closing Date, and, subject to Section 6.2, zoning ordinances and regulations of record. Except with regard to liens of an ascertainable amount which will be paid by Seller at Closing, Buyer shall be deemed to have waived any liens, encumbrances or survey or title defects ("Title Exceptions") as to which it does not notify Seller within forty-five (45) days from the date hereof. This waiver shall not apply to any Title Exception which first becomes of record (whether or not it relates back to an earlier date) after the date of Buyer's title report and prior to the Closing. Section 7.2.

Title Report and Survey. Promptly after Opening of Escrow, (i) Seller shall deliver to Buyer a copy of the existing ALTA survey of the Sale Property in Buyer's possession (the "SURVEY"), (ii) Escrow Agent shall issue to Buyer a preliminary title report incident to the issuance of the title policy referred to in Section 7.2, together with legible copies of matters shown on Schedule "B" thereto (the "TITLE REPORT"), and (iii) Buyer shall have prepared, at Buyer's expense, an update of the existing Survey (the "UPDATE").
Title Report and Survey. Promptly after the execution and delivery of this Agreement, Seller shall provide Buyer with (a) a current title report for the Real Property, (the "Title Report") prepared by First America Title Guaranty Company (the "Title Company"), (b) copies of documents referenced in the exceptions set forth in the Title Report, and (c) the Survey. In addition to any and all exceptions approved by Seller pursuant to Section 5.1.1 below, the Title Report shall be subject to and Buyer hereby approves as "Permitted Exceptions" the following: (i) exceptions for general taxes not yet due and payable, and (ii) matters affecting title attributable to the acts of Buyer and its agents, contractors and employees.
