TIPS AND GRATUITIES. Subject to the above provision in respect to the distribution of gratuities, no employee covered by the Collective Agreement shall be required to share with any other person or with the Employer any tips or gratuities that he or she may receive directly from a customer of the Employer. The Employer will not take any action that would prohibit or discourage its customers from giving tips or gratuities to employees.
TIPS AND GRATUITIES. All tips and/or gratuities (collectively referred to as “Tips”) that are received from customers will be placed into an employee-controlled “Tip Pool”. Any amendment to the gratuity distribution arrangement as it applies to employees in the bargaining unit during the life of the Collective Agreement will be decided by a majority of the employees affected, provided the change can be reasonably accommodated by the Employer’s administrative system. Bargaining unit employees shall have access to relevant information in order to verify gratuities and/or service charges. Gratuities will be paid out within three (3) weeks of being earned. The Employer agrees that commissions, if any, will be paid out once per year during the month of December. The Employer will, at the same time, provide the Union with the total amount of commissions paid out to employees.
