Common use of Timely Response Clause in Contracts

Timely Response. Subject to section 7.3.2, and except as expressly provided by the terms of this Agreement, the LHIN will respond to Hospital submissions requiring a response from the LHIN in a timely manner and in any event, within any time period set out in Schedule B. If the LHIN has not responded to the Hospital within the time period set out in Schedule B, following consultation with the Hospital, the LHIN will provide the Hospital with written Notice of the reasons for the delay and a new expected date of response. If a delayed response from the LHIN could reasonably be expected to have a prejudicial effect on the Hospital, the Hospital may refer the matter for issue resolution under Article 11.
