Time for Submittal. Contractor shall timely and properly submit a minimum of one reimbursement request for each reporting period, even if Contractor did not make any expenditures in performance of the activity that are reimbursable under this Contract during the reporting period and the reimbursement request is for zero dollars ($0). Within forty- five (45) calendar days after the date of performance of any labor or services as part of the activity, purchase of materials, supplies or equipment relating to the activity, or receipt of an invoice for any expenditures incurred by Contractor relating to the activity, in each case that are reimbursable under this Contract, Contractor shall submit a reimbursement request for such labor, services, materials, supplies, equipment, or other expenditure(s) to City. Any failure to so submit a reimbursement request may be deemed a waiver of Contractor’s right to reimbursement for such labor, services, materials, supplies, equipment, or other expenditure(s). Contractor shall submit to City any and all final reimbursement requests, including any documentation substantiating the requests, within thirty (30) calendar days after the earlier of: (a) completion of the activity; (b) expiration of the Contract term; or (c) termination of this Contract. Contractor waives any and all right to submit any documentation of activity expense or to receive reimbursement for any activity expense submitted to City for reimbursement after such thirty (30) calendar day time period. Furthermore, any remaining CDBG funds balance in the budget for which a reimbursement request has not been properly and timely submitted to City before the expiration of such thirty (30) calendar day time period shall be subject to reprogramming by City, without notice to Contractor.

Time for Submittal. Where Shop Drawings are required for (a) fabrication of Subcontractor-furnished equipment or appliances, (b) installing Subcontractor-furnished material, equipment or appliances, or (c) planning and performance of the Work under the Subcontract Documents, such Shop Drawings shall be in compliance with the Subcontract Documents and shall be submitted by and at the expense of the Subcontractor within fourteen (14) days of Subcontractor’s execution of the Agreement and any updates, or at least thirty (30) days before fabrication, installation, or performance (as the case may be), but in no event on any date which would not allow reasonable time for review by the Contractor, Owner and their respective consultants. The Subcontractor shall review, approve and submit, to the Contractor, Shop Drawings and similar submittals required by the Subcontract Documents with reasonable promptness and in such sequence as to cause no delay in the Work or in the activities of the Contractor or of separate contractors or other subcontractors. Such Shop Drawings shall include, but are not limited to, erection diagrams and other details, such as field connections for proper installation, erection of the equipment, appliances and performance of the Work. Submittals made by the Subcontractor, which are not required by the Subcontract Documents, may be returned without action.
Time for Submittal. Requests for Information shall be submitted to District Project Manager no later than three (3) Days after the date Design-Build Entity learns of the circumstances giving rise to the question contained in the Request for Information.

Trees or pieces presented for Scaling that have not been bucked to separate material meeting minimum piece standards from material not meeting minimum piece standards due to diameter, shall be Scaled as though such bucking had been done. Deductions made for rot, check, or other defects re- sulting from abnormal delay in Scaling caused by Pur- chaser shall be recorded separately and charged to Xxx- ber Sale Account under B3.47. Any timber that has been removed from Sale Area during the period of this contract, but remains unscaled after Termination Date, shall be Scaled at the earliest rea- sonable date.

  • Examination of an application for an industrial design 1. A formal examination of the application for an industrial design received by the federal executive authority for intellectual property is carried out which includes checks on presence of the documents specified in clause 2 of Article 1377 of the Civil Code of the Russian Federation and its compliance with the established requirements. If the result of the formal examination is positive, then a substantive examination of an application for an industrial design is carried out, which includes: information search in relation to the claimed industrial design to determine the publicly available information, which shall be taken into account when examining the design patentability; examination of the claimed industrial design for the compliance with the requirements under Article 1231.1, clause 4 of Article 1349 of the Civil Code of the Russian Federation, and the patentability criteria under the first paragraph of clause 1, clause 5 of Article 1352 of the Civil Code of the Russian Federation; examination of the claimed industrial design for the compliance with the patentability criteria under the second paragraph of clause 1 of Article 1352 of the Civil Code of the Russian Federation. An information search in relation to the objects specified in sub-clause 4 of clause 4 of Article 1349 of the Civil Code of the Russian Federation shall not be carried out, and the federal executive authority on intellectual property notifies the applicant about it. 2. If, as a result of the substantive examination of an application for an industrial design, it is found that the claimed industrial design represented on the reproductions of an external appearance of the article does not relate to the objects specified in Article 1231.1 or clause 4 of Article 1349 of the Civil Code of the Russian Federation and meets the patentability criteria under Article 1352 of the Civil Code of the Russian Federation, the federal executive authority for intellectual property makes a decision to grant a patent for an industrial design. The date of filing of the application for the industrial design and the priority date of the industrial design shall be specified in the decision. If, during the process of substantive examination of an application for an industrial design, it is found that the claimed object does not meet at least one of the requirements or patentability criteria specified in paragraph one of this clause, the federal executive authority for intellectual property makes a decision to refuse the issuance of a patent.

  • Requests For Samples By Authorized Users Requests for samples by Authorized Users require the consent of the Contractor. Where Contractor refuses to furnish a sample, Authorized User may, in its sole discretion, make a determination on the performance capability of the Product or on the issue in question.   • Application for Use a. The Employer agrees to accept properly executed leave applications within six (6) months of the first day of the period of leave being requested.

  • Time for Completion The Contractor shall deliver the material and/or services called for in the specifications/proposal and within the delivery time specified and in accordance with the terms of the contract. Work shall be completed within 30 days from the Notice to Proceed issued by the City of Sparks Purchasing Division. The Contractor shall not alter or vary any terms or conditions contained or incorporated herein, including but not limited to, the quantity, price, delivery date or date designated as After Receipt of Order (ARO) or date for commencement or completion of services as mutually agreed upon, unless such alteration or variation is consented to in writing by a duly authorized representative of the City. The City reserves the right to cancel resultant Contract upon ten days written notice in the event the type and quality of the product or work performance is unsatisfactory or in default, subject to Contractor’s right to cure as outlined in termination clause. This is a non-exclusive Contract and the City reserves the right to acquire the material and/or services at its discretion, from other sources during the term of this Contract.
