Time Extensions for Weather. 1. The Contract Time will not be extended due to inclement weather conditions that are normal to the general locality of the Work site. The time for performance of this Contract is in calendar days and all requests for time extension due to inclement weather shall be made in calendar days.

Time Extensions for Weather. The Contractor's sole relief on any claims for delay which is caused by abnormal weather shall be an extension of the Time for Completion provided the Contractor gave the Project Officer written notice no later than Five (5) calendar days after the onset of such delay and provided the weather affected the Critical Path. A fully documented claim for a time extension under this Section must be submitted no later than Thirty (30) calendar days after the cessation of the delay. It shall be the Contractor’s responsibility to provide the necessary documentation to satisfy the Project Officer that the weather conditions claimed were encountered, which may include daily reports by the Contractor, copies of notification of weather days to the Project Officer, NOAA backup, and pictures from each day claimed. The Time for Completion will not be extended due to inclement weather conditions which are normal, as defined below, for Arlington County. The Time for Completion includes an allowance for Workdays (based on Five (5) day Workweek) which according to historical data may not be suitable for construction Work. The Contractor may request extension to the Time for Completion if it can demonstrate unusual and disruptive weather conditions per the requirements below:

COUNTY will review the request and determine in its sole discretion whether the situation warrant a time extension at no-cost or with costs. If CONTRACTOR completes the Task Order beyond the stipulated completion date without COUNTY’s specific written approval for time extension, CONTRACTOR will be subject to liquidated damages and may be construed as non-responsive, which may affect CONTRACTOR for considerations for future Task Orders or projects.
