Third Party Warranty. Except as otherwise provided above, Xxxxxxx makes no warranty, express or implied, with regard to third party hardware or software and expressly disclaims the implied warranties or conditions of merchantability or merchantable quality, fitness for a particular purpose, title, infringement and those arising by statute or otherwise in law. Customer’s sole recourse for warranty claims is with the manufacturer of the Product. However, Xxxxxxx agrees to pass through any third party warranty that Xxxxxxx receives from the manufacturer of the Products to Purchaser. The extent of any third party warranty details, terms and conditions, remedies and procedures may be expressly stated on, or packaged with, or otherwise accompanying the Products.
Third Party Warranty. 11.1 The Supplier shall within seven days if so required by the Company enter into a warranty with any third party warranting that the standard of the Goods provided is in accordance with the Contract and the Order and that they are fit for the intended purpose.

XXXXXXX SHALL NOT, IN ANY EVENT, BE LIABLE FOR ANY CONSEQUENTIAL, INCIDENTAL, INDIRECT, SPECIAL OR PUNITIVE DAMAGES SUFFERED BY PURCHASER OR ANYONE CLAIMING BY, THROUGH OR UNDER PURCHASER, AS A RESULT OF THE CONDITION OF THIS PRODUCT, OR ANY PART OR PORTION THEREOF. SOME STATES DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS OR PROHIBIT THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION AND EXCLUSIONS MAY NOT APPLY IN YOUR STATE. THIS WARRANTY IS GOVERNED BY THE LAW OF THE STATE OF INDIANA WITHOUT REGARD TO ITS CONFLICTS OF LAW PRINCIPLES. Third Party Warranty. 9.1 The Company shall not be responsible for any damage loss, cost or expenses of every description to persons or property arising as a result of use of the vehicle or otherwise relating to the vehicle.
Third Party Warranty. Nokia does not honor warranty agreements extended by third parties, and only warranty agreements granted and given by Nokia will be honored by Nokia. Nokia warranties do not cover damage caused by third party products (including approved third party products).

Third Party Warranty. For any equipment or product that comprises or is part of Constructed BPL Network that is not BPL Equipment, such equipment and products being set forth in Schedule G, the Seller shall assign or pass through, as the case may be and to the extent such assignment or pass through is permitted, to the Buyer all warranties and indemnities offered by the manufacturer or a vendor or dealer of such equipment or product, which shall extend only for such time as the third party product manufacturer provides such warranty, which the Seller and the Buyer acknowledge that such warranty may not be for the same duration as the Product Warranty provided herein by the Seller. At the Buyer’s request, the Seller authorizes the Buyer to assert for the Seller’s account, all rights of the Seller (granted under this Agreement) under any manufacturer’s, vendor’s, or dealer’s warranty or indemnities on any third party equipment or product comprising or part of the Constructed BPL Network, and the Seller agrees to cooperate, subject to Buyer’s reimbursement of Seller’s reasonably incurred costs and out-of-pocket expenses, with the Buyer in asserting such rights.
Third Party Warranty. Namos makes no representation whatsoever in respect to any third-party Software made available through or provider to the Customer in the provision of the Services and are not responsible for the Customers use of any third- party Equipment or Software, property damage, or other harm or losses arising from or relating to the Customer’s use of any third-party Equipment or Software. Any warranty provided to Namos in respect of the Software or Services supplied under the Agreement shall, where possible, be transferred to the Customer, subject to any terms or restrictions imposed by the software vendor.
Third Party Warranty. Visiopharm has no liability or responsibility for statements in user manuals, specification, catalogs, brochures or technical information relating to Third Party Products. Visiopharm may refer Customer to the manufacturer or supplier of any Third Party Product in case of doubt about such products’ functionality or application. Third Party Products are governed by the warranty provided by the manufacturer of Third Party Products and Visiopharm disclaims all warranties, express or implied, with respect to Third Party Products. However, Visiopharm will endeavor to assist the Customer in exercising the Customer’s rights under any warranty that the manufacturer or supplier of each such product has provided. Requests for such assistance must be communicated in writing to Visiopharm upon discovery of the defect and in any event before the expiry of the manufacturer’s warranty period. Where changes have been made to Third Party Products (or to configurations of Visiopharm’s software and Third Party Products) Visiopharm may decline to provide customer with any such assistance. To the extent that any law may impose warranty obligations upon Visiopharm with respect to Third Party Products despite the disclaimer above, Visiopharm will be entitled to remedy any defect by changing or repairing the product, and the Customer may not demand any other remedy, cancel the purchase, claim a proportionate reduction in the purchase price, withhold a portion of the purchase price, or claim damages. In order to exercise any rights under such a warranty the Customer will be required (a) to communicate any claim in writing to Visiopharm upon discovery of the defect, and in any event before the expiry of manufacturer’s warranty period; (b) to make the product available to Visiopharm and return it to Visiopharm upon request; and (c) to pay shipment costs for transport of the product to and from Visiopharm. No warranty obligations will apply where changes have been made to Third Party Products (or to configurations of Visiopharm’s software or Third Party Products).

For the purpose of this Warranty, the Shelter System shall include the Shelter 9KX Cylindrical Lock, 45HX Mortise Lock, Shelter FOB, Shelter Gateway, Shelter Repeaters and any Shelter Repeater accessories.
