Third Party Licensors. 5.10.1 The Client acknowledges and agrees that the provision of an Electronic Trading Platform may involve the sub-licensing of Licensor software and/or information systems.
Third Party Licensors. (a) The Software contains software developed by third parties, and each such third party may be considered a third party beneficiary of your obligations under this Agreement.
Third Party Licensors. Licensee agrees that any third-party licensor of any portion of the Indices or Marks may enforce its rights against Licensee as an intended third party beneficiary of this Agreement and applicable Order Schedule, even though such licensor is not a party to this Agreement and such Order Schedule.
Third Party Licensors. If Veeva licenses any of the data included in the Data Products from a third-party source (“Third-Party Licensor”), Veeva may disable access or remove data provided by a Third-Party Licensor from the Data Products if Veeva’s agreement with any such Third-Party Licensor is terminated or expires. Third Party Licensors. Customer acknowledges and agrees that: (a) certain elements of the Features (including Cloud Platforms) are owned by Pluralsight’s third-party licensors (including Cloud Providers); (b) the acknowledgments, obligations, restrictions, and undertakings given or accepted by Customer in this Schedule are for the benefit of Pluralsight and its third-party licensors, with such licensors being third-party beneficiaries with the right to enforce this Schedule directly against Customer or through Pluralsight; and (c) Customer is prohibited from bringing any claims related to Pluralsight’s Products or Services against Pluralsight’s third-party licensors.
Third Party Licensors. The Parties agree and acknowledge that each of Pacira, RDF and OctoPlus have certain respective rights and obligations under the RDF Agreement and the OctoPlus Agreement. The Parties agree that this Section 7 shall be subject in all respects to the applicable terms and conditions of the RDF Agreement and the OctoPlus Agreement and, in the event of any conflict between the terms of the RDF Agreement or the OctoPlus Agreement, on the one hand, and this Agreement, on the other hand, the terms of the RDF Agreement or the OctoPlus Agreement, as applicable, shall govern.
Third Party Licensors. All Third Party Software used or provided by ev3 pursuant to this Agreement is and shall remain the property of the applicable Third Party Software licensor pursuant to the terms set forth in the applicable Third Party Software license attached to Exhibit A.
Third Party Licensors. To the extent that a Third Party licensor has retained any right to enforce or otherwise be involved in the activities specified in this Section 11.1 for any Patent, ATI shall use commercially reasonable efforts to cause such Third Party licensor to take the actions specified by this Section 11.1 in a manner consistent with the agreement(s) by which such Third Party retains such rights, but ATI shall not be deemed to be in breach of its obligations under this Section 11.1 if, after using such commercially reasonable efforts, it is unable to comply with such obligations because of actions taken or not taken by such Third Party licensor.
Third Party Licensors. No later than C-CDR, Contractor shall identify in writing to TerreStar all known third parties whose Intellectual Property Contractor contemplates incorporating in the Satellite Chipset or that is otherwise necessary for the manufacture of the [***]. Such known third party is a “Third Party Licensor.”
