Common use of Third Party Action Clause in Contracts

Third Party Action. If a third party initiates a claim of any nature in any court against any of the Parties arising out of or relating to any provision of this Agreement, the Parties agree that, as to such claim, the Party so named in such court proceeding may implead or otherwise join any of the remaining parties in that proceeding, and that the existence of Sections 9.02 and 9.03 hereof (and the remedies prescribed thereunder) shall not act as a defense or bar to such impleader or joinder.
