Third Level. If a satisfactory settlement is not reached at the second level, either party may voluntarily request mediation through the Bureau of Mediation Services. The School Board will receive notice the grievance has reached the third level. Both parties must agree to use this step; otherwise, the unresolved grievance will proceed to the fourth level. If no agreement is reached within twenty (20) days, the unresolved grievance will proceed to the fourth level.
Third Level. All employees who have a Bachelor’s Degree, from an accredited school, shall receive a sum equivalent to 5% of base monthly salary, for 12 months thereafter. Base salary will be established by the salary table in Section 2 of this agreement. Third Level. If the grievance is not settled at the Second Level, the grievant may appeal to the School Board by submitting a written request to the Superintendent within fourteen (14) days of receipt of the response from the Superintendent. The Board may conduct a hearing in executive session on the appeal of the grievance within thirty-five (35) days following receipt of the notice of appeal. The participants at the hearing shall be limited to the individual(s) involved at the second level of the formal grievance procedure. The hearing shall be limited solely to reviewing the information presented at the second level grievance conference. The Board will take final action on the grievance at the next regular meeting after the hearing. The Superintendent will transmit the Board's disposition of the grievance in writing to the grievant(s) and the President of the Association.
Third Level. The balance of the Net Receipts remaining, after the distributions under the First and Second Levels above, shall be distributed to the Members in proportion to their Percentage Interests. All Net Receipts distributable to Carlyle 14 and Carlyle 15 pursuant to this SECTION 2.06(b) shall be distributed in the ratio of their Percentage Interests.

Third Level. The balance of the Disposition Proceeds remaining after the distributions under the First and Second Levels above shall be distributed to the Members in accordance with their respective Percentage Interests. The cash portion of the Members' share of Disposition Proceeds, together with all installments and payments of cash of or against any deferred portion of such Disposition Proceeds, shall be distributed in accordance with the levels provided above, with each person or entity entitled to payment under a level receiving the entire amount of such cash until the sum payable under such level shall have been discharged in cash. All Disposition Proceeds distributable to Carlyle 14 and Carlyle 15 pursuant to this SECTION 2.06(c) shall be distributed in the ratio of their Percentage Interests.
Third Level. If no resolution is achieved at the second level of review, the issue will be elevated to State Fund's State Contract Services CalHR Liaison, the Workers' Compensation Manager at CalHR, and the Department Director for resolution.
