THEFT OF SERVICE/LAWFUL PURPOSES ONLY a. Customer may not use or obtain MASSIVE NETWORKS’ Services and/or Voice Services in any manner that avoids MASSIVE NETWORKS policies and procedures, including an illegal, fraudulent, improper, or inappropriate manner. If MASSIVE NETWORKS believes that Customer has used MASSIVE NETWORKS Services or Voice Services for an unlawful purpose, MASSIVE NETWORKS may forward the relevant communication and other information, including Customer’s identity, to the appropriate authorities for investigation and prosecution, and Customer consents to MASSIVE NETWORKS forwarding of any such communications and information to these authorities. Customer will notify MASSIVE NETWORKS immediately if Customer believes that the Service and/or Voice Service is being stolen, fraudulently used, or otherwise being used in an unauthorized manner, or if Customer’s Customer Premises Equipment is lost or stolen. When Customer notifies MASSIVE NETWORKS of one of these events, Customer must provide the account number and a detailed description of the circumstances of the theft, fraudulent use, or unauthorized use of the service. If Customer fails to notify MASSIVE NETWORKS in a timely manner, MASSIVE NETWORKS may disconnect the Services and/or Voice Services and impose additional charges against Customer. Until Customer notifies MASSIVE NETWORKS and MASSIVE NETWORKS takes action to prevent use of service using reasonably best efforts, Customer will be liable for all use of MASSIVE NETWORKS service using a device and/or Customer Premises Equipment lost or stolen from Customer and any stolen, fraudulent, or unauthorized use of MASSIVE NETWORKS service whether or not it involves a lost or stolen device or Customer Premises Equipment.

  • Determination of Service for Sick Leave with Pay Actual time worked and all leave with pay, except for educational leave, shall be included in determining the pro rata accrual of sick leave credits each month, provided that the employee works thirty-two (32) hours or more in that month.

  • Payment of Service Fees Customer will pay the Service Fees for Services ordered by Customer, and all other amounts due under the Agreement, pursuant to the terms of this Section 5.

  • Subcontracting for the Provision of Services (a) The parties acknowledge that, subject to the provisions of LHSIA, the HSP may subcontract the provision of some or all of the Services. For the purposes of this Agreement, actions taken or not taken by the subcontractor, and Services provided by the subcontractor, will be deemed actions taken or not taken by the HSP, and Services provided by the HSP.

  • Payment of Services 1. For courses taught at a High School facility utilizing High School teachers who are qualified by the DCCCD College using Southern Association of Colleges and Schools Commission on Colleges (SACSCOC) standards to teach college level courses, DCCCD shall pay as follows:

  • Transition of Services Upon request by the State prior to expiration or earlier termination of this Contract or any Services provided in this Contract, Contractor shall provide reasonable and necessary assistance to accomplish a complete transition of the Services from Contractor to the State or any replacement provider designated solely by the State without any interruption of or adverse impact on the Services. Contractor shall cooperate fully with the State or any successor provider and shall promptly take all steps required to assist in effecting a complete transition of the Services designated by the State. All services related to such transition shall be performed at no additional cost beyond what would be paid for the Services in this Contract.

  • Unpaid Leave for Family Purpose a. An employee may elect, with the consent of the employer, to take unpaid leave for the purpose of providing care and support to a member of a class of person set out in sub-paragraph (ii) or paragraph (c) of sub-clause (1) who is ill.

  • Termination of Services 6.2.   • Disruption of Service Customer acknowledges and understands that Voice Service will not be available for use under certain circumstances, including without limitation when the network or facilities are not operating or if normal electrical power to the MTA, ATA or ALG is interrupted and such equipment does not have a functioning backup. Customer also understands and acknowledges that the performance of the battery backup is not guaranteed. If the battery backup does not provide power, Voice Services will not function until normal power is restored. Customer also understands that certain online features of Voice Service, where such features are available, will not be available under certain circumstances, including but not limited to the interruption of the Internet connection.

  • Calculation of Service 25.7 For purposes of calculating continuous service and active service, a year shall be deemed to consist of two hundred and sixty-one (261) working days.

  • Compensation for Damages or Losses When investments by investors of either Contracting Party suffer damages or losses owing to war, armed conflict, a state of national emergency, revolt, insurrection, riot or other similar events in the territory of the other Contracting Party, they shall be accorded by the latter Contracting Party a treatment, as regards compensation or other settlement, not less favourable than that accorded to its own investors or to investors of any Third State.
