Common use of The Orders Clause in Contracts

The Orders. On the date of the making of the initial Loans hereunder, the Interim Order will have been entered and will not have been stayed, amended (without the Agent's prior written consent, which consent shall be in its sole discretion), vacated, reversed or rescinded. On the date of the making of any Loan, the Interim Order or the Final Order, as the case may be, shall have been entered and shall not have been amended, stayed, vacated or rescinded without the Agent's consent (acting with the consent of, or at the direction of, the Required Lenders). Upon the maturity (whether by the acceleration or otherwise) of any of the Obligations of the Borrower and the Guarantor hereunder and under the other Loan Documents, the Lenders shall, subject to the provisions of Section 7.01, be entitled to immediate payment of such obligations, and to enforce the remedies provided for hereunder, without further application to or order by the Bankruptcy Court.
