The Backup Servicer. (a) The Issuer and the Trust Depositor hereby appoint Lyon Financial Services, Inc. to act as Backup Servicer in accordance with the terms of this Agreement. Lyon Financial Services, Inc. hereby accepts such appointment and agrees to perform the duties and responsibilities with respect thereto set forth herein.
