Terms of Appointment; Duties of the Bank. 1.01 Subject to the terms and conditions set forth in this Agreement, the Trust hereby employs and appoints the Bank to act as, and the Bank agrees to act as registrar, transfer agent for the Trust's authorized and issued shares of its beneficial interest ("Shares"), dividend disbursing agent and agent in connection with any dividend reinvestment plan as set out in the prospectus of the Trust, corresponding to the date of this Agreement.
