Terms and Conditions During Leave. 2.1 During periods of family leave, employees are entitled to benefit from the terms and conditions of their contract that would have applied had they not been absent except in relation to remuneration. The employee is bound by any obligations under their contract except those that are inconsistent with their rights to take leave, such as the obligation to attend work.

Terms and Conditions During Leave. The duration of educational leaves will normally be for a period of up to one academic year. If management determines that the needs of the business would best be served by an employee taking an educational leave, then Hydro One will maintain the employee's full salary, health and dental benefits and reimburse costs. For other educational leaves, management will reasonably determine the level of financial assistance that the company will provide to the employee during the leave based on the expected resulting benefit to the business. Where management continues to pay all or a portion of an employee's base salary during an educational leave, it shall also maintain health and dental benefit coverage for the employee for this period. Where Hydro One requires an employee to take an educational leave, the company will pay the employee's full salary, health and dental benefits and reimbursable costs, including all reasonable incremental expenses (e.g., travel, accommodation, meals). Where Hydro One requires an employee on leave to return to work prior to the expiry of the approved leave, the company will assume all expenses incurred as a result of this action. As a condition of granting a leave application by an employee, Hydro One may require a participating employee to sign a written commitment to return to Hydro One following the expiry of the leave for a period not to exceed four times the duration of the leave times the percentage of base salary paid by Hydro One during the leave. Where Hydro One requires an employee to take an educational leave, there will be no period of stipulated continued employment. Treatment of Employee on Return from Leave Upon completion of the leave, where the employee's position continues to exist and has not been filled or has been filled temporarily, the employee shall return to that position. Upon completion of the leave, if the employee’s position no longer exists or has been filled by an ongoing appointment, the employee will be placed in a position at the same salary grade and same location as the pre- leave position. In the event Article is triggered during or upon completion of the leave, the employee will be redeployed in accordance with that Article. For purposes of reinstating such optional coverages, the following limitations shall be applicable. For the first twenty-four (24) months of long-term disability coverage after such a period of leave or layoff during which long-term disability coverage was discontinued, any such disability coverage shall exclude coverage for pre-existing conditions. For disability purposes, a pre-existing condition is defined as any disability which is caused by, or results from, any injury, sickness or pregnancy which occurred, was diagnosed, or for which medical care was received during the period of leave or layoff. In addition, any pre-existing condition limitations that would have been in effect under the policy but for the discontinuance of coverage shall continue to apply as provided in the policy. The limitations set forth above do not apply to leaves that qualify under the Family Medical Leave Act (FMLA).
