Common use of Termination of Seniority Clause in Contracts

Termination of Seniority. An employee's seniority shall be terminated when one or more of the following occur: 1) the employee resigns; 2) the employee is discharged for just cause; 3) the employee is laid off for a period of time exceeding two (2) years; 4) the employee retires; and 5) the employee refuses a recall or fails to report to work within ten (10) calendar days from the date the City sends the notice of recall. (It shall be the employee's responsibility to provide the City with his/her current address for notification during the period of layoff.)

Termination of Seniority. An employee's ’s seniority shall be terminated when one or more of the following occur: 1) the employee he resigns; 2) the employee he is discharged for just cause; 3) the employee he is laid off for a period of time exceeding two twelve (212) yearsmonths; 4) the employee he retires; and 5) the employee he refuses a recall or fails to report to work within ten five (105) calendar working days from the date the City Employer sends the notice of recall.
