Common use of Termination of Proceedings Clause in Contracts

Termination of Proceedings. In case any proceedings taken by the Trustee or any one or more Bond Owners on account of any Event of Default shall have been discontinued or abandoned for any reason or shall have been determined adversely to the Trustee or the Bond Owners, then in every such case the Agency, the Trustee and the Bond Owners, subject to any determination in such proceedings, shall be restored to their former positions and rights hereunder, severally and respectively, and all rights, remedies, powers and duties of the Agency, the Trustee and the Bond Owners shall continue as though no such proceedings had been taken.

In case the Bond Trustee shall have proceeded to enforce any proceedings taken right under this Bond Indenture by the Trustee appointment of a receiver, or any one or more Bond Owners on account of any Event of Default otherwise, and such proceedings shall have been discontinued or abandoned for any reason reason, or shall have been determined adversely to the Trustee or the Bond OwnersTrustee, then and in every such case the Agency, the Trustee Issuer and the Bond OwnersTrustee shall, subject to any determination in such proceedingsproceeding, shall be restored to their former positions and rights hereunder with respect to the property pledged and assigned hereunder, severally and respectively, and all rights, remedies, remedies and powers and duties of the Agency, the Bond Trustee and the Bond Owners shall continue as though if no such proceedings had been taken.
