Common use of Termination of Employee Plans Clause in Contracts

Termination of Employee Plans. At the Closing, the Company shall terminate its 1995 Stock Plan and 1999 Stock Option Plan as well as the Company's 401(k) plan, and shall ensure that no Person has any rights under any of such Plans and that any liabilities of the Company or its Subsidiaries under such plans (including any such liabilities relating to services performed prior to the Closing) are fully extinguished at no cost to the Company or its Subsidiaries.
