Unitus reserves the right to amend, modify, revoke, or cancel the terms of this Agreement or any transaction services contemplated herein. If applicable law requires notification, notice will be mailed to you at the address shown on Unitus' records. It is the obligation of each member to update any new address. Any revised, amended, or modified conditions, rules, and/or regulations shall be effective at the earliest date allowed by law. You can terminate this Agreement by notifying Unitus in writing. Termination of service will be effective the first business day following receipt of your written notice. Termination of this Agreement will not affect the rights and responsibilities of the parties under this Agreement for transactions initiated before termination.

Whether you or any other party to your account that we have canceled or will cancel the Credit Union terminates this Agreement; • Three or more overdrafts occur as a result of nonsufficient or unavailable funds on an account; • Any transaction on your accounts which results in a monetary loss to Unitus; • Your delinquency on any loan or Visa credit card account with Unitus; • Forced closure of any of your accounts at Unitus due to misuse; or • Any other situation in which Unitus deems revocation to be in its best interest. As permitted by applicable law, you agree that any legal action regarding this Agreement shall be brought in the county in which the Credit Union is located. You must file any lawsuit or request arbitration against us within one year after the cause of action arises, unless federal or state law or an applicable agreement provides for a shorter time. This one-year limit is in addition to any time limits on notice as a condition of making a claim. For purposes of a lawsuit or arbitration concerning a fee or charge assessed to your account, the cause of action will be deemed to have arisen or accrued on the date the first such fee or charge being complained of was assessed regardless of whether you had actual or constructive knowledge of any such cause of action, and you expressly waive any application of or reliance on any theory or doctrine of a continuing violation or breach or any other doctrine which might otherwise serve to toll or delay the beginning of the one-year limitation period. For any and all causes of action arising or accruing before terminationthe date this paragraph first became effective, July 1, 2021, you must still file any lawsuit or request arbitration against us within one year after July 1, 2021, and you acknowledge and agree that one year is a reasonable period of time to discover any such cause of action and bring suit or request arbitration, and you expressly waive any reliance on any vested or unvested rights you may have had under any other, longer statute of limitation. LINKING DEBIT CARD TO ACCOUNTS For card access and designating primary account: Linking lets you add accounts you own (i.e. checking, savings) to a debit card, giving you access to make transactions initiated before terminationon multiple accounts with one card at LegacyTexas ATMs. If you link only one account of a single type (i.e. checking or savings) to the card, that linked account is automatically designated as the 'primary” account. For purposes of electronic fund transfer services, the primary account for a debit card must be a checking account. The money for purchases and payments made with your card is deducted from your primary checking account. Cash withdrawals using a debit card at a non-LegacyTexas ATM are deducted from the primary checking or savings account. If you link more than one account of a single type to the card, you may designate a primary account and other accounts. If you do not designate a primary account, the first account of that type linked to your card is considered the primary account. If a primary account linked to the card is closed or delinked for any reason, we will designate another linked account (if applicable) as the new primary account. To access line of credit account at ATMs: If you link your line of credit account to the card, you may use the card to access the linked credit account at any LegacyTexas ATM. You can use the card to obtain cash or transfer funds from the linked line of credit, as long as the linked account is in good standing and has available credit. Cash withdrawals and transfers of funds from your line of credit are treated as cash advances. Each of these transactions is subject to the provisions of the separate Line of Credit Agreement and Disclosure. TYPES OF TRANSACTIONS Below are the types of transactions your Card will accommodate. ATM Transfer. You may access your account by ATM using your Card and PIN to: • make deposits to your account • withdraw cash from your account - you may withdraw no more than your daily limit • transfer funds from and to linked accounts • obtain balance information Some of these services may not be available at all terminals. Point-of-Sale Transactions. You may access your account with your Card to purchase goods or pay for services (in person, by phone, or online), get cash from a merchant, if the merchant permits, or from a participating financial institution, and do anything that you can do with a credit card (that a participating merchant will accept with a credit card). Using your Card and/or PIN: • for your security and fraud protection, you may not exceed the daily transaction limit or • your daily dollar limitations ATM and Merchant Terminal Malfunctions. We are not responsible for damages resulting from an ATM or merchant terminal malfunction. You will promptly notify us if a LegacyTexas ATM fails to dispense the correct amount of cash or provide a receipt by calling or writing us at the telephone number or address provided on your periodic statement Currency Conversion and International Transactions. When you use your Card at a merchant that settles in currency other than U.S. dollars, MasterCard International Incorporated will convert the charge into the U.S. dollar amount. MasterCard International will use its currency conversion procedure, which is disclosed to institutions that issue MasterCard cards. The currency conversion rate used by MasterCard International to determine the transaction amount in U.S. dollars is generally either a government-mandated rate or a wholesale rate determined by MasterCard International for the processing cycle in which the transaction is processed, increased by an adjustment factor established from time to time by MasterCard International. The currency conversion rate used by MasterCard International on the processing date may differ from the rate that would have been used on the purchase date or statement posting date. MasterCard International charges an Issuer Cross Border Assessment Fee on all international transactions. Refer to the Schedule of Fees for applicable fees. There may be additional charges coming from any transaction done over the internet, by phone or in person for purchases made with a merchant that processes their transactions internationally. These are fees passed through the merchant and/or processor and in either case we pass this transaction fee on to you. DAILY LIMITS, FEES AND AVAILABLE BALANCE You may use the Card subject to the standard 1) daily ATM withdrawal limit and daily purchase limit, unless approved for higher limits, and 2) your available balance in your account. For purposes of the daily limits only, a 'day” is defined as the 24-hour period from midnight to midnight, Central Time. If a transaction is made in another time zone, it will be processed when we receive it. The following rules apply: Limits on dollar amounts: • Daily ATM withdrawal limit is the maximum amount of cash you can withdraw from any combination of accessible accounts using your card. • Daily purchase limit is the maximum U.S. dollars amount of purchases that can be debited from your account. In certain circumstances we may allow Card transactions that exceed your daily purchase limit. The Limits for your Card. You can confirm your Card’s daily dollar and transaction limits by contacting us at 000-000-0000. Changes to Card limit. We may, without telling you, increase your daily purchase or ATM withdrawal limit based on account history, activity, and other factors. We will notify you if we decrease the daily limits for your Card. Fees for using Card. Refer to the separate Schedule of Fees for any associated charges for use of the Card.
