Termination for Excusable Delay. If, due to an Excusable Delay, Delivery of the Aircraft is delayed more than sixty (60) days beyond March 10, 2006 (or such later date agreed to by Buyer and Seller in writing) then Buyer or Seller may terminate this Agreement by giving written notice to the other party at any time after the expiration of such sixty (60) day period. Termination under this Section shall terminate and discharge all obligations and liabilities of Buyer and Seller hereunder and all undelivered items and services hereunder which are related thereto. Following such termination, the Deposit (together with interest accrued thereon) shall be returned to Buyer in accordance with the Escrow Agreement.
