Common use of Termination for Death or Disability Clause in Contracts

Termination for Death or Disability. In the event that Executive’s employment is terminated by death or because of Disability pursuant to Section 4.3, in addition to the payment of accrued salary and unused vacation provided in Section 5.1, the Company shall pay to Executive’s estate or to Executive, as the case may be, compensation which would otherwise be payable to Executive through the end of the month in which such termination occurs, and payment for any accrued but untaken vacation days.

Termination for Death or Disability. In the event that Executive’s employment is terminated by death or because of Disability disability pursuant to Section 4.3, in addition to the payment of accrued salary and unused vacation provided in Section 5.1, the Company shall pay to Executive’s estate or to Executive, as the case may be, compensation which would otherwise be payable to Executive through the end of the month in which such termination occurs, and payment for any accrued but untaken vacation days.

In If the event that Executive’s 's employment is terminated by due to death or because of Disability pursuant to Section 4.3, in addition to the payment of accrued salary and unused vacation provided in Section 5.14.2, the Company shall continue to pay to Executive’s the estate of the Executive or to the Executive, as the case may be, compensation which would otherwise be payable for a period of 90 days after termination of employment due to Executive through death or Disability, the end Executive's base salary as in effect on the date of the month in which such termination occurs, and payment for any accrued but untaken vacation daystermination.

In the event that If Executive’s 's employment is terminated by due to death or because of Disability pursuant to Section 4.3, in addition to the payment of accrued salary and unused vacation provided in Section 5.15(b), the Company shall will: (i) pay to Executive’s Executive (or his estate or a designated beneficiary) any earned and unpaid Base Salary and accrued bonus or other incentive payments through the date of death or Disability and (ii) for one (1) year following the date of Executive's death or Disability, continue to Executive, as provide the case may be, compensation which would otherwise be payable benefits then available to Executive through and his eligible family members under Section 4 of this Agreement to the end of the month in which such termination occurs, and payment for extent permitted by law or any accrued but untaken vacation daysapplicable insurance carrier.

Termination for Death or Disability. In the event that If Executive’s 's employment is terminated by death or because of Disability disability as determined pursuant to Section 4.3, in addition to the payment of accrued salary and unused vacation provided in Section 5.15.3, the Company shall be obligated to pay to Executive’s estate Executive or to Executive, the Estate (as the case may be) a severance payment in an amount equal to six (6) months, compensation which would otherwise be payable to Executive through the end or after an extension, one (1) full year of his Base Salary in effect as of the month effective date of termination to be paid in which such termination occurs, and payment for any accrued but untaken vacation daysaccordance with the Company's payroll practices under Section 4.

Termination for Death or Disability. In the event that If Executive’s 's employment is terminated by death or because of Disability disability as determined pursuant to Section 4.3, in addition to the payment of accrued salary and unused vacation provided in Section 5.15.3, the Company shall be obligated to pay to Executive’s estate Executive or to Executive, the Estate (as the case may be, compensation which would otherwise be payable ) a severance payment in an amount equal to Executive through the end one (1) full year of his Base Salary in effect as of the month effective date of termination to be paid in which such termination occurs, and payment for any accrued but untaken vacation daysaccordance with the Company's payroll practices under Section 4.

In If, prior to the event that expiration of the Term, Executive’s employment is terminated by due to death or because of Disability pursuant to Section 4.3, in addition to the payment of accrued salary and unused vacation as provided in Section 5.13.1(a) hereof or disability as provided for in Section 3.1(b) hereof, Executive shall be entitled to receive (i) any accrued and unpaid benefits as of the Company shall pay to date of death or disability, (ii) any accrued and unpaid Salary as of the date of death or disability and (iii) continued payment of Executive’s estate or to Executive, as the case may be, compensation which would otherwise be payable to Executive through the end Salary for a period of the month in which such termination occurs, and payment for any accrued but untaken vacation dayssix months thereafter.

In If the event that Executive’s 's employment is terminated by due to death or because of Disability pursuant to Section 4.3, in addition to the payment of accrued salary and unused vacation provided in Section 5.1, 5 (d) the Company shall continue to pay to Executive’s the estate of the Executive or to the Executive, as the case may be, compensation which would otherwise be payable for a period of 90 days after termination of employment due to Executive through death or Disability, the end Executive's base salary as in effect on the date of the month in which such termination occurs, and payment for any accrued but untaken vacation daystermination.

Termination for Death or Disability. In If the event that Executive’s employment is terminated by death or because of Disability pursuant to Section 4.3, in addition to the payment of accrued salary and unused vacation provided in Section 5.1Paragraph 5(a)(i), the Company shall pay to Executive’s the estate of the Executive or to the Executive, as the case may be, compensation which the Base Salary and regular (non-incentive) benefits that would otherwise be payable to the Executive through up to the end last day of the month in which such termination occurs, and payment for any accrued but untaken vacation daysExecutive’s employment.

Termination for Death or Disability. In the event that If Executive’s 's employment is terminated by death or because of Disability pursuant to under Section 4.3, in addition to the payment of accrued salary and unused vacation 4.4 other than as provided in Section 5.15.3(a), the Company shall will pay to Executive’s the estate of Executive or to Executive, as applicable, the case may be, compensation which would Base Salary and benefits otherwise be payable to Executive under Sections 3.1, 3.2 and 3.4 above through the end of the month in which such termination of Executive's employment because of death or Disability occurs, and payment for any accrued but untaken vacation days.

Termination for Death or Disability. In the event that Executive’s employment is terminated by death or because of Disability disability pursuant to Section 4.3, in addition to the payment of accrued salary and unused vacation provided in Section 5.15.3, the Company shall pay to Executive’s estate or to Executive, as the case may be, compensation which would otherwise be payable to Executive him under Section 4.1 of this Agreement through the end of the month in which such termination occurs, and payment for any accrued but untaken vacation days. Executive or his estate shall also be eligible to receive any benefits which he or it are entitled to receive under the various Company fringe benefit plans for the six months following Executive’s death or disability.

Termination for Death or Disability. In the event that of the Executive’s death or Disability, the Company may (in the case of Disability) terminate the Executive’s employment is terminated by and its sole obligation hereunder shall be to continue to pay to the Executive (or, in the case of death or because incompetence, to her personal representative) her salary under Section 3(a) hereof for a period of Disability pursuant to Section 4.3, eighteen (18) months following the date of death or termination. Executive shall also be paid a prorated portion of her bonus paid in addition to the payment of accrued salary and unused vacation provided in Section 5.1, the Company shall pay to Executive’s estate or to Executive, as the case may be, compensation which would otherwise be payable to Executive through the end of the month in which such termination occurs, and payment for any accrued but untaken vacation dayslast full fiscal year.
